  • I-485 Rejection Issue

    Hello all,

    I recently had my I-485 rejected that was filed on 12/16/19. The I-797C says, "The application/petition was filed on an outdated version of this form. Please resubmit your application/petition on the current version of this form with the appropriate fees to the address listed on the bottom of this page."

    The I-485 I submitted was dated 07/15/19 with an expiration date of 2021 (which is up-to-date according to the USCIS website) and the I-864 form I submitted was dated 03/06/18 with an expiration date of 03/2020 (also up-to-date per the website).

    For reference, this is for a K-1 Visa where we had our I29f accepted and got our visa and have married within the 90 day window.

    Curious as to if this is just a general message it adds?

    It also says, "The application/petition has not been fully completed. One or more of the following field(s) were not completed: - I am filing as"

    However, I do not see any "I am filing as" sections in either of the 485/864 forms and have filled them out just like other K-1 Visa examples have shown online.

    Any ideas as to what I may have done wrong?

    This is not a big issue. I did the same and all I had to do was download the latest version of the form and refile with the rejection letter on top of the application packet.

      It's not the expiration date you need to look at, it's the "Edition date" that defines which form the USCIS is currently accepting. Like Henry says, it's not a big deal. Just redo everything using the newer form and resend the same packet.

        07/15/19 is the latest for I-485
        03/06/18 is the latest for I-864

        I don't have experience with the K-1 visa, either they made a mistake or is something different that you need to file.
        Nov 2018 - Package sent - EB - Texas Service Center
        Day 1 - Package received at the lockbox
        Day 999 - Card delivered to me - Aug 2021

          There is a section on both I485 and I864 that questions 'who you are filing as". It is in the first set of questions.
