  • I-751-Removal of Conditional GC -Address requirement Query

    Hello,

    I understand I am in wrong forum but This is the only active forum regarding GC Questions I found. I hope someone can help me with my 1-751-Removal of Conditional GC Query

    US Citizen filed for spouse through AOS(I-485) (NJ)
    GC filled- 01/2018
    EAD received- 06/2018
    Interview scheduled- 10/2018
    GC Approved- 10/2018(Same Day)
    GC Received- 11/2019 (within 5-7 days upon approval)
    Removal of Conditional GC due date: 10/2020

    Now that in 2020- we need to apply to remove condition on GC between 08/2020 to 10/2020 , I have question regarding Address requirement:

    We have stayed in NJ from 2018-2019(End)-NJ-StateID
    Moved to CT from 2019(End) to 2020(Mid)- CT StateID
    Planning to go back to NJ on 09/2020 - NJ State ID

    Can we file from NJ on 09/2020 as our deadline for filling I-751 is on 10/2020? Do I-751 have any address requirement/Restrictions? can we file from the state where we recently moved?


    I really appreciate if someone can help

    you have to file you address change with USCIS, you need to apply 90 days before your GC expires even if you are planning to move within those 90 days. When you move after you filed your I-751 you need to file the address change again with USCIS and your case will be processed accordingly.

      the previous comment has some misinformation. you need to file within the 90 days window not at the 1st day when the window opens.

      for you this is pretty straight forward, if you go back to NJ by 09/20 and your deadline ends on 10/20, just file when you move to NJ and avoid the hassles of changing address. add all supporting evidences (including the new house deed/rental receipt and utilities) and shoot. people file early because these days USCIS takes close to 2 months to give you NOA.

          One more question:

          If GC Spouse is out of US to visit other country, Can we file I-751 -Removal of GC Application during that time?

          Example: I am US Citizen, We plan to visit other country in August 2020 (I-751-Due date 10/20)
          Can we apply through online or mail on August 2020 , when we were traveling abroad?
