  • H1B Holder applying for Green Card through marriage

    Hello!

I've been living in the US for the last five years and currently working on H1B visa, which is due for extension in Sept 2021. I'm married to a US citizen and am looking to start my application for marriage-based Green card. I have a couple questions on the application process:

    1. Based on my research so far, I understand that we MUST submit forms I-130, I-130A, I-485, I-864 along with supporting documents as part of the application packet to USCIS. Is my understanding correct or am I missing some other forms that need to be submitted as part of application packet?
    2. Can the above forms be filled online or is it recommended to fill them offline and mail it in a physical application packet?
    3. Since I'm already on H1-B visa that expires in late 2021, do I need to apply for an EAD card (Form I-765) or is this optional for me?
    4. What is the cost breakdown if I also apply for an EAD card (Form I-765) and Advance Parole (Form I-131) along with the rest of the application?

Thanks in advance for your help and support!

    1. You will also require I-693(sealed) with your original packet.
    2. Offline an mail the packet.
    3. It is suggested to apply but not necessary. In worst case scenario, if you employer let you go, having the EAD and advanced parole will help you to keep employed and travel.

    Hope this helps.

Thank you for your response. Do you happen to know whether I would need to pay an additional fee in case I apply for EAD and AP along with the other forms mentioned in point #1?
I don't mind applying for EAD as a back up if it's free, however, I do not want to spend an additional amount of application fee for it since I already have a valid H-1B.

I-765 for EAD and I-131 for AP are both currently free for I-485 applicants.

This is my personal opinion and is not to be construed as legal advice.
