  • Concerns Regarding Intent on Entry

Hi everyone, I'm new here, and I had a question I wanted to throw out there.

A bit of background. I'm a Canadian citizen who has been studying in the US on my F-1 for nearly a decade now (since 2009), and I fell in love with my current partner in early 2018. I proposed to him around March 2019 and set a date to go to City Hall for the ceremony in late May 2019. At the time, I had not made a decision regarding the immigration process, since I was planning on either returning to Vancouver or Hong Kong (my parents are there) after I finish my studies/training.

In early May (after the proposal but before the marriage), a few friends and I went to Montreal for a couple days. Upon return to the US, I was admitted under the F-1 status. Two and a half weeks later (late May), my partner and I got married. In June, we re-visited the issue of immigration and where we would be in 10 years, and he convinced me that staying in the US was the way to go. We submitted out AOS that September (2019).

This brings me to the problem:

I had intent to marry at the time of my entry (May 2019), but no intent to immigrate. However, I am extremely concerned that the USCIS will misconstrue my intent to marry as an intent to immigrate, since my marriage occurred within 3 weeks of my re-entry.

    1) Will it be very difficult to convince the USCIS that I entered without intent to immigrate, but only with intent to marry?
    2) HOW **** -ED AM I???? Ugh.

Thanks everyone. I'm really hoping this trip didn't completely ruin my hopes.

You’re not in trouble. You’ll be fine. Do not overthink it. As long as your marriage is bonafide, there is nothing to worry about.
