  • Interview Reschedule Nightmare

    My wife (US citizen) and I (applicant) could not attend our scheduled i-485 interview (Jan 8th) as we were out of the country with pre-planned travel (seeing my grandmother who is in hospice care).
    We following the instructions outlined on the interview request letter, and called USCIS to reschedule the interview (on Dec 11th). The officer we spoke with put in a request, to which we received an email (on Dec 20th) stating: " Your request will be forwarded to file for officer review. We will mail you a notice when we make a decision, schedule a interview, or need something from you."

    Between Dec 11th and Jan 8th, I called USCIS twice every week to confirm that I have done everything correct and that we have not received any updates since the Dec 20th email (nothing in the mail whatsoever). All of the officers that I spoke with told me that there is nothing further for me to do, and to just wait on the local office (San Jose) to responded in the mail.

    As of Jan 8th (the scheduled interview date), the I-485 status was updated to "Case Was Updated to Show That No One Appeared for In-Person Processing". I immediately called USCIS and got to speak with a tier 2 officer, who told me that there is nothing that they could do, that this will seriously affect the outcome of my case, and that they may close my case.

    It is now Jan 11th and I still have nothing in the mail (over 4 weeks since I put in the request) and I'm really concerned that they will close my case.

    Has anyone been through a similar experience? I do not have any lawyer and really not sure what to do, currently waiting to see what we get in the mail...

    This past week I read another case like yours.

    I don't know what information you submitted to convince the officer your reason was good enough. From what I read the "No Show" update is automatic and doesn't mean that for that reason your case will be denied. You have that email and you called several times (they must have records for that).

    I think they will make a decision from the information you sent and they will reschedule. They can make mistakes or decide the reason to not go to the interview is not good enough, but that is another story. Good luck.

      I’m sorry this happened to you. This is why as much as possible, it’s best to avoid rescheduling interviews if applicants can. Either something like what happened to you could happen or it could take forever for an interview to be rescheduled. It’s risky. Please do hire a good lawyer if you don’t have one yet.

        cali1234888 so sorry this happened to you. There are several people I've seen that has went through this as well. I think the miscommunication in this instance is that just because a request is put in does not necessarily mean it was approved. It looks like you put in a request to reschedule but you have not received confirmation of approval for the reschedule as yet, which may mean that they have not approved it and therefore not processed it in the system before you left. I would try to confirm and if all else fails and they do mark it as a no show, I suggest getting a good lawyer that is knowledgeable with the circumstance you are in.

          cali1234888 I feel san jose is the worst FO. You should contact USCIS and talk to a tier 2 officer and let them know about your reschedule requests that you put in previously. If you have any emails as proof of rescheduling your interview (USCIS confirmation # of your reschedule request) you should mail them to the FO with your i485 and I130 receipt copies and a letter explaining your reschedule reasons and the proof related to that. Hoping the best for you.
