  • Different than usual F2A case.

    Hello everyone, I am bringing you guys a rather different than usual F2A case that I need your comments on. I live in Richmond, VA btw.

    A little bit of background:
    - I was adopted by my aunt because my bio mom was unable to take care of me. So my aunt became my legal parent.

    - When my aunt (legal parent) became a permanent resident, she filed a petition for me to become a PR.

    - However, after an RFE, the petition was denied due to inconsistency in documents proving that I was living with her continuously for 2 years before filing the petition.

    Now:
    - My aunt filed form I-130 again. This time we made sure that everything was consistent.

    - USCIS received the I-130 and gave us the priority date of January 18, 2018.

    - However, we waited a year and a half and NOTHING happened.

    - We read online that I would be able to file form I-485, along with form I-765, when the "Dates for filing family-sponsored visa applications" on the visa bulletin went past my priority date in June 2019.

    - We filed form I-485, I-765 and I-864 and mailed the package to the USCIS Chicago Lockbox in June 2019.


    Here's my timeline:

    01-18-2018 - PD. I-130: "Case was received." No further update on I-130.
    06-23-2019 - I-485, I-765, and I-864 package was delivered to USCIS Chicago Lockbox.
    07-17-2019 - Received two text messages with two receipt numbers for I-485 and I-765.
    07-19-2019 - Received biometrics appointment.
    08-09-2019 - Biometrics captured.
    08-21-2019 - EAD card is being produced.
    08-22-2019 - I-765 approved.
    08-26-2019 - EAD card was mailed.
    08-28-2019 - EAD card received.
    09-09-2019 - SSN card received.

    Unusual things:
    - I-130's case status is still at "Case was received."

    - The package was delivered by USPS on June 23, 2019, but I didn't receive any updates on whether USCIS had received it or not until July 17, 2019, when I received two text messages giving me two case numbers for I-485 and I-765. To clarify, I didn't receive any text messages or NOAs prior to July 17, 2019. I was frustrated and I was seriously about to send another package.

    - After my biometrics were taken, my I-765 and EAD card were approved and mailed LIGHTING fast compared to other cases (within the same month).

    - My I-485 case status is still at "Fingerprint fee was received" even after my I-765 was approved. Shouldn't it say "Fingerprint review was completed?"

    What are your thoughts and comments on my case? When do you think I will receive an interview appointment and/or green card? Thanks.

    Sometimes they don't update the fingerprint status for I-485, so don't worry about that.

    I think your age is important. As long as you are not over 21 or married F2A is ok. What status in the USA did you have before AOS? I guess that your process will be ok because they approved the EAD very fast.

      Right now I'm 19 and I will turn 20 in June 2020.

      Before AOS I was a student with an F-1 Visa. Quick question: What exactly is my status right now when I'm in the process of AOS?

      Also, I really hope that I could get a green card soon so I could apply for in-state tuition.

        Hi, let me see if I understood correctly. Were you able to file the I-485 with the I-130 still being pending? My priority date in the visa bulletin is "current", but the lady helping me with paperwork doesn't want me to submit the I-485 until I get the approval notice of the I-130. I read online that if my priority date is current, I should send the I-485 before a year passes and USCIS dismiss my case because I didn't do anything. I'm category F2A, married with a legal permanent resident. Please help!!!

          Your status could be F-1 if you are following everything that is required with F-1, if you already used your EAD or AP then you are no longer F-1 (from what I read). I think there is no status per se, just that you are doing AOS to LPR, some say "pending status" or "pending I-485". If you are no longer F-1 it is recommended that you properly close your status with your school. Go to international services and tell them you are in the process to get a GC.

            Yes, you can file I-485 while the I-130 still pending as long as the date on USCIS site allows you to file I-485. I think people attach a copy of the I-130 receipt to their I-485 package.
