  • AOS after 13 years

    Hi;

    I am in a same sex relationship and my boyfriend who's a US citizen and I have decided to tight the not. I am honestly freaking out about this whole process. I came to the US under a B1/B2 and the last time I entered the country was May 2008. My boyfriend has already talked to a lawyer about our case and he seems pretty excited. I am just concerned about the fact that I've been here out of status for so long and that that matter would be an issue once we have our interview. My question is, how do you handle this at an interview? Because I'm sure the officer will ask a lot and freaks me out that I could be deported there. Maybe I am just overreacting? Any thoughts? I don't have any criminal records nor I've ever been in trouble. And I only have a few parking tickets haha.

    Try to relax, I have read posts from people that overstayed for many years (I think one was over 20 years) and the marriage with USC was real, in the end, all cases received the GC.

        Your situation is similar to mine .
        I came to the US back in 2007 J1 visa I overstayed like 10 years and I met my husband in 2011 , got married May 2018 and we applied for AOS (Same Sex )
        we had our interview December 17, 2019 and IO officer never mentioned anything about my overstay she only asked dates and my first arrival to USA. I got a 2 years conditional Green card .
        just relax once you’re in AOS process married to a USC your overstay and illegal work are pardoned . And good luck !

          You’ll be fine. They tend to forgive AOS applicants who “overstay”. Relax and just shift your focus onto gathering your joint evidence.
