  • Help for Sponsoring Mother (widowed) for GC

    Hi All,
    I am Naturalized US Citizen and I want to sponsor my Mother's Green Card. I have filled the I-130 form online and what I wanted to know is my Mom is travelling on B2 Visa (tourist) to USA on Feb 02nd 2020 and I am not sure if I should I file I-130 and I-485 now before her travel or should I just wait till my Mother arrives in USA and then fill the I-130 and I-485 form.
    Also one more question I have is should I be filing only for I-485 or I have to file first for I-130 and then I-485 (may be together).

    I am little confused about how I should be proceeding ahead with the forms and what should I chose as the Location that my Beneficiary (Mother) goes for the Immigration Visa (since she could be in USA on B2 visa) and little confusion is here that if she would be going here in the USA for her Immigration Visa interview after filing.

    Any help on the above?

    She should not enter on B2 with the intention of doing Adjustment of Status (I-485) during that stay.

      I guess you should have waited for your mother to be in US then file the I-130 and I-485 at the same time so, that she would have to stay in US until her I-485 is approved and there will be no interview for her as she is the parent of a US citizen.

      What I understood is you already filed I-130 online right ?
      then if that is the case then
      I guess she needs to wait until both the petitions are approved (I-130, I-485). It is advisable not to travel to US because of the conflict at the port of entry as she will be entering as non immigrant but the immigrant petition is already in the system (Flag and Conflict).

        @luckcharm411 Thank you for your response, I stopped filling any forms infact and as of now nothing is in the system so I dont think we will have any issue. I didnt submit any forms just was filling them online and saving it. So we are good here and thank you for your detailed help on this. I will wait to fill out and submit forms untill we decide to go for it and possibly after she arriving here in USA.

          You need to understand the immigration laws first before filing for your mother.....seek a lawyers advise...my opinion don't file if she is travelling on B2 visa. Then consult your lawyer....
