  • I Need Clarifications on this

Hello Great People, please can someone enlighten me on this situation.
i got married to a US citizen in November 2017 and had my interview in December of 2018, an RFE was given which was submitted in January of 2019.
My first EAD expired in August of 2019 and I was giving the 180 days extension while I was renewing. I got my renewed EAD (1 year) in November 2019.
My surprise now is am yet to get my green card but when I went to renew my driver’s license last month January, when I thought it should be valid for 1 year as per the EAD validity, I got 4 years on my driver’s license and no Limited Term on it. What does this imply?

Implies nothing, but why wouldn't you follow up with USIS to see what is up with your case? also what was the RFE for?

The RFEs requested were supporting marriage documents....It was a stokes interview and the interviewer never checked out documents because we didn’t take the certified marriage certificate along.

I received a 6 years driver's license and my EAD will expire in less than 2 months, they haven't approved my EAD renewal yet.
No Limited Term on it, that was a surprise too.

No idea. I think it is different for each state. In Texas they scan all your information and send an electronic request to confirm the legal status of the person, the system receives the answer and depending on what it receives the license expiration date is set. No idea why I received 6 years, for the past 5 years I have received 5-6 licenses with a validity of a few months up to a year. I was expecting a license for only 2 months up to 8 months (for the 180 days after expiration for the renewal process). Not having Limited Term was a surprise too, as far as I know, I'm still considered as a temporary visitor according to the DPS webpage:
A temporary visitor is anyone who is not a U.S. citizen, U.S. national, lawful permanent resident, refugee or asylee.
I hoped that means something but I don't think it does.

But will a temporary visitor be given the license like that of a PR or a US citizen? What status is an EAD holder categorized as? Do DMVs connect with USCIS database before issuing a license? What determines the validity on the license of an EAD holder waiting on green card

My experience is for Texas, and from what I read no, a temporary visitor should not get a 6 years license. Anyway, in my case I didn't get the exact same license as a LPR or a USC because mine doesn't expire on my birthday, just 6 years from the day I renewed.

The process is Texas is like this:
                • they scan your evidence
                • sent the request to verify to DHS (U.S. Department of Homeland Security)
                • they can send back confirmation in a few seconds
                • if they can't confirm the legal status DPS will tell you to wait for a letter in a week or so because DHS was not able to confirm the legal status and must go to the second stage
                • if after the second stage they can't confirm then there is the third stage

                  Gat you....mine is in Chicago.
The 4 year license issued to me will expire on my Birthday in my own situation. Just like the ones issued to LPR or USC

The state driver’s licenses is issued with the number of yrs the specific state allows and has nothing to do with the immigration time limit. At least this is how it works here in CT. DMV only want to verify you are eligible for a DL and once you are you get whatever the state allows.

also keep in consideration that in most states illegal immigrants can get a legit DL therefore I think it’s safe to say there’s no correlation with the USCIS time limit and time issued on your DL.

The license duration in Texas depends that you are legal and they verify DHS to give you a Limited Term license, usually, up to your visa expiration.

That's why I received 5 licenses in 5 years and this is the first time I get a 6 years license even when my EAD will expire in less than 2 months. For some reason, DHS sent back authorization to renew my current license for 6 years and without the legend "Limited Term".

I only expected a 6 years license when I receive a GC, maybe in 2021.
