  • 7 months after the interview and no news

    Employment based green card. I went for the interview last August, everything was fine and the officer told me I was going to get the card in a couple months. Fast forward 7 months and the status hasn't changed, it still shows "Interview was completed and my case must be reviewed". My priority date is current. I've called USCIS multiple times and they say everything is fine and it is within the processing time.

    Any ideas in how to expedite it? My company is getting acquired soon and I'm afraid that will impact the process (any advice about this situation?). Thanks.

    And talking about my company acquisition, how does it impact the AOS at this moment?

      Call. Do a case inquiry. Contact your congressman/representative.

      I guess that after acquisition if you stay employed with the same level/salary there is no problem. I read that you can even change jobs after 180 days since submitting the I-485.

        I have a service request open with USCIS, but I'm sure they will say it still within the processing time. I agree it is, but 7 months to make a decision? And this acquisition now makes me stay awake at night..
        I might try a congressman, do you think it is worth a shot?

          I really don't know, but at least you feel that you are doing something to get an answer. Good luck, I hope you get your GC soon.

              What I found is that my application was sent back to NBC because at the moment of the interview my priority date was not current because of the retrogression. It became current again in October 2019, but my application is still sitting at NBC, it was never sent back to the field office for adjudication.

                A few weeks ago I got in touch with my local congressman and his office made a inquiry to USCIS, still waiting for a response for more than 2 weeks.

                  And now with the visa retrogression for March 2020, I don't think the adjudication will happen any time soon. Thank you USCIS.

                    What do you mean retrogression? Not sure i understand. Do priority dates still matter after you file for 485? I am clueless.
                    11/5/19 I-485, I-485 J, I-765, I-131 receipt
                    11/30/19 Biometrics notice
                    12/13/19 Biometrics done.
                    2/25/20 EAD sent to production.
                    2/26/20 131 approved
                    2/27/20 Ready to be scheduled for interview. EAD shipped
                    3/2/20 EAD combo card in hand
                    3/5/20 fingerprints applied to 131
                    3/26/20 Interview Cancelled (Never scheduled)
                    7/30/20 New card is being produced
                    7/31/20 I-485, I-485J Status changed to Case Approved
                    8/7/20 Received I-797C for 485 and 485J
                    8/19/20 Card was mailed to me
                    8/22/20 GC in hand

                      Some categories are subject to retrogression dates. Marriage to a USC is not one of them. Here the talk is about employment-based AOS.

                          Well, there are different categories and quotas in some countries. If your category and/or country is not in retrogression you could get your GC as long as your PD is current.

                            If you check here https://travel.state.gov/content/tra...arch-2020.html you can see that EB3 (my case) retrogressed to 2017. If you are in EB2 you should be fine. But it's just frustrating, going through all the steps and now getting hanging in this never ending process without a clear answer why.

                              Got an email answer from USCSI for my inquiry (took them 32 days to answer) and of course they are now blaming the regression:

                              Our records show that your Form I-485 is currently held in abeyance until an Immigrant Visa becomes available. This is known as Visa Regression. If a regression of priority dates occurs due to an oversubscription in a category, as determined by the Department of State, USCIS is legally prohibited from granting permanent residence to adjustment applications affected by the regression. By long-standing practice, USCIS holds such applications in abeyance until visa numbers become available.
