Hello to everyone,
I've been following the forums on here now for quite a while and I found them very very useful. My husband and I recently got married and we're organizing all paperwork so he could petition me. We went over all the forms that we needed : I-130, G-325, I-485, I-765 and the I-864. The only thing that we're stuck on is the I-864 which is the Affidavit of Support.
Here's the thing:
When we read the instructions it said that the petitioner needs his 3 most recent Federal Income tax returns. the problem is, he only has '08 and '09 because in '07 he had just turned 18 and his income was too low, causing his parents to claim him when THEY filed for their taxes.
I guess what confuses us the most is also that fact that it said, we can just file the most recent one (which would be the 09).
does this mean then that we just dont file 07 and 08 then?
and another thing, my husband is in the Marine Corps so automatically, we only have to meet the 100% poverty guideline and not the 125% and for the 09' income tax, we went over that guideline.
I know this is rather long and I apologize but if anyone can clear this up for me it will be greatly appreciated.
