  • Should I mention citation on I-485?

Hi all! I’m sure it’s been talked about many times but I just need some reassurance from experts. I’m an alien seeking adjustment through marriage to US citizen. The thing is that I was involved in a car accident in 2016, which was not my fault, but I was given a citation for driving without a license (never had one issued) and was ordered to show up in court for hearing. Basically my lawyer went for me and I was just ordered to pay fine of $320. It was a misdemeanor 2nd offense. Should I put yes on a question about “have you ever been arrested, cited etc”? I have certified paperwork from court that shows that the case was dismissed and I paid the fine. I’m leaning towards saying YES and just explaining everything on the interview. What do you think?

Yes, you should still check yes and include the paperwork to confirm it was dismissed. Also get a police record check as well to include in your packet.

      You should put Yes

This is my personal opinion and is not to be construed as legal advice.
