  • URGENT HELP - UPS Postmark Date Problem - i-485 Feb 24 Deadline

    Hello everyone,

    I sent out all my forms and information for a one step adjustment this past weekend, meeting the deadline for the Feb 24 new forms cutoff. I sent it on a Saturday when only UPS/FedEx were open close by, and thought it was okay to just send it through ground mail (instead of express). As I was sending, I noticed that UPS does not provide postmark dates, but was reassured by the clerk that the online tracking information would show that detail. Now I am looking online (after it finally posted) and it's not showing anything about a postmark or a receipt date. It says, just as on the package, that it was shipped on the 24th. I do have the payment receipt and the label receipt with me that clearly show that I paid on the 22nd, but I am not sure if USCIS will be able to verify this information (especially since UPS doesn't show it online). At this point I have the following questions:

    1) How does USCIS confirm such UPS cases because they do accept UPS services but do not mention anything about attaching proof of receipt/procedure/etc
    2) If my forms are rejected, will they send my stuff back, or will they send an RFE? If it's RFE I might just be okay but refiling will be fatal
    3) Will calling USCIS, or sending them a copy of the receipt, beforehand do any good or should I wait until they review my application?
    3) Is there any way to get UPS to show billing date online? Or will the tracking page actually show the date once the package is delivered?


    My main worry is that a flat out rejection will create a lot of problems specific to my case, so I hope that it doesn't get any worse than an RFE.

    If anyone has any knowledge or past experiences with this, please let me know. Thank you.

    From what I read your case will be either: a) accepted or b) rejected, you won't receive an RFE.

    I don't have a package with UPS information so I don't know if they put a date on the label.
    A FedEx package I have says: Shipped on <Date>
    A USPS package I have says: Priority Mail <Date> Mailed from ZIP xxxxx

    If the UPS label says Feb 22 you will be ok, if it says Feb 24 or no date, then, most likely, they will reject your package.

      Thanks. It only shows shipped date, which is later than the deadline. But they mention that they accept UPS so don't they have some type of a verification system in place? Lastly, if I get rejected, can I resend my application and attach proof that I sent it on time by attaching my receipt that shows the data and time of transaction?

        The actual label that they created doesn't have any date? I haven't paid attention to those details. I hope the label has a Feb 22 date and you will not have any problems.

        I don't think they will allow you to resubmit the documents with proof that you went to UPS on Feb 22 but I don't really know. Good luck and keep us posted.

          I ended up sending an additional letter with a screenshot of the shipping label receipt that shows the date and time. Will this have any impact on the rejection process?

            Enub4 There is a date - it is the shipping date. Which says the 25th. At the time of sending I thought USCIS has some type of a system in place to check (like looking up tracking number online) since they work with UPS but I thought too highly of them. If I sent it express, the shipping date would have said 22nd or 23rd, which would have been fine. I'm hoping my letter reaches them in time and they see the actual receipt date.

              Wow, I didn't know that if you select different services will have a different ship date. I always assumed that the label should show the date they received the package.

                According to the USCIS announcements,
                For applications and petitions that are sent by commercial courier (such as UPS, FedEx and DHL), the postmark date is the date reflected on the courier receipt.
                Do you have a date on your receipt?

                  newacct Yes, and it does show the date that I dropped off my mail. Not sure why I didn't send it with my package. I mailed the picture of my receipt to them this afternoon with an overnight mail, but not sure how it will be handles once it arrives. And if I get rejected, not sure if I can appeal it either.
