  • Fiance traveling to US To Visit

    My friends fiance is traveling to the US to visit but shes afraid that if she says her intention of traveling to visit her fiance they might think she is coming here to get married. She is from India and she's coming here for 4 weeks. Ideally, they want to get married at some point in the future. Any tips on what to say when she comes in ?also, if she does decide to stay, can she do adjustment of status here with no issues ?

    Any input would be appreciated. Again, this is for his fiance. Just posting for them.

    Traveling to the USA with the intention to marry and stay is against policy and may get the case denied. Always tell the truth. If the travel is for vacation/tourism you don't need to say that your traveling to see your fiance, just vacation. If they are staying with fiance, then that address must be reported, if they ask who lives there then they will need to answer that the fiance lives there.

    Having a round trip booked and showing ties with the home country may help the officer let them in, but the officer may deny entry if they are not convinced.

    After seeing the new form I-944 I think consular processing may be faster than AOS. Getting diplomas, credit reports, credit scores, and everything else will be time-consuming. Good luck with whatever they decide to do.
