  • Should I Refile?

    Quick question:

    Downloaded all AOS forms in mid-Feb. My wife and I completed them and sent them on the 29th February.

    On the 1st March I noticed that the i-765 and i-485 forms had changed to new editions (with practically no advance warning), and that i-944 was now required too.

    I'm certain our package is going to be rejected, so is it advisable to send an entirely fresh packet in with all the new editions *before* we get a NOA?

    Would really appreciate some guidance here. Super stressed out by this all (I am currently employed but will need the new EAD by mid-August when my university job (visiting instructor) resumes after the Summer semester break).

    If you used the wrong edition forms. The packet will be rejected and returned to you. If the packet is accepted and you get i-787 receipts notice then I would complete and return the i-944 with a copy of the i-485 receipt. Dis you make two separate payments for for the i-130 and i-486+Biometrics? In that case the could accept the i-130 and reject the i-485.

    I would wait a bit before refiling until you know whether they accepted the package or rejected it.

      Thanks so much for answering! Yes, we did separate payments, and thankfully the i-130 hadn't changed, so let's hope they accept that and just ask for the rest of the materials. We couldn't have picked a worse time to have downloaded the other forms, apparently!

      The i-944 is pretty onerous too, especially if someone came here after having done an undergraduate degree abroad (as I did). Should have those materials sorted within the week, but it's been a $500 additional hit, all things considered (materials, transcript verifications, anticipated rush postage).

      Really appreciate your answer, and thanks for alerting me to the idea that they might part-accept the package. I will absolutely wait. Should be hearing from them early next week, based on other timelines.

        My situation is the same as yours. I called USCIS on March 3rd to ask about this. They said that they will either issue RFE or rejection notice so you can resubmit your application. Don't worry to much, they won't charge money until all the necessary documents are received.
        03/24/2020: Sent package to USCIS.
        03/25/2020: Package received by USCIS.
        04/14/2020: 4 text messages received and checks cashed.
        04/23/2020: 4 NOAs received in mail.
        08/17/2020: Biometrics Appointment letter received in mail for 08/25.
        08/25/2020: Fingerprints taken and applied to I-765 and I-485.
        09/01/2020: Case is ready to be scheduled for an interview.
        09/08/2020: New card is being produced.
        09/11/2020: I-765 and I-131 were approved and mailed.
        09/16/2020: Combo card in hand.

          I am in the same boat. I sent my application on 2/24 with I-485 old edition form and USCIS received it on 2/25. I haven't received any NOA yet! Lets keep each other posted since we're all in the same situation. I'll let you know as soon as I hear something.

            Yep! I'll keep you up-to-date as well. We haven't received any NOAs either. Package was received by USCIS on March 1.

              So I just got my package back from USCIS with the rejection letter. The NOA says that my application was rejected/returned because it was filed on an outdated version of I-485. I knew this was going to be the case so I had filled out updated forms already and I'm thinking of refiling the application early next week. Everything was returned and they didn't accept the fee either. Hope this helps! Let me know if you have any questions.

                Thanks so much for updating me! (Had been looking to see!)

                I haven't received anything back, but, anticipating rejection, I've got the updated forms filled out too (and will be aiming to refile by the end of next week, all being well).

                Will update when I get the package back, and will update with when I'm sending stuff out.

                Thanks again, Deeps87. Will be a weight off my mind when I get this sent out properly. I was just bemoaning my luck today that of course I picked the worst couple of weeks to download, print, fill out, and send out the package.

                  No problem! and I feel your pain.. infact I sent my package ON 2/24 and that's the day this public charge rule came into effect. It took me couple of days to process that after all this work my application could get denied or something. I am glad its just rejection and not denial! The waiting game definitely sucks but I hope you hear back from them soon! I'll keep posting updates on this thread.

                    I guess you received rejection letter 2 weeks after you sent your application. I'm wondering if I receive rejection letter or not because I used updated form for I-485.

                      Yes. I got the whole package back along with rejection letter after 2 weeks. Hmm not sure about your case! I guess you just have to wait and see what happens.
