Hey y’all. If anyone has an input on this please reply back. So my mom came to USA 20 yrs ago. She later applied for a family visa with my dad and brother and self so we can come. We overstayed our visas and now I have citizenship and would like to sponsor her. 2 years after we came my mom and dad separated and he left USA and got remarried and then my mom also remarried. The problem is that my mom never got divorced from my dad. All this time she believed he had done it but apparently not. So now my mom might have committed bigamy. When time comes does she have to submit divorce or marriage license as evidence. This is child to parent petition. She can’t disclose her second marriage because people are saying it’s not valid. But I worry with background checks they will find this marriage. Anyone that petition one parent did y’all submit any marriage license or divorce decrees

Your Mom should file for the divorce from her 1st husband and then remarry the second. All marriage and divorce records are required. Don't take the chance of your mom being denied for fraud.
