We submitted our I-485 (along with all other documents, for EAD, ...) end of February and recently got a I-485 Receipt (Notice Type: Receipt). Today, we also received a date for the biometrics appointment.
I'm wondering about this passage: "If you have filed Form I-485, Application to Adjust Status, you generally are not confined by the restrictions on your nonimmigrant visa. You have the right to remain in the United States while the application is pending. " (from https://citizenpath.com/faq/maintain...-filing-i-485/)
In particular, my wife's student visa expires in May and if she is not in valid status, she will have to apply for OPT (eligble for one year) by mid of April. Given the current situation around coronavirus, it is hard to say whether she will find a job though.
How do I know whether my wife's application is pending? Can she already overstay her visa with the I-485 being submitted and retrieving a receipt for it? Or is the "PENDING" part later (e.g. after biometrics?) https://egov.uscis.gov/casestatus/mycasestatus.do states: "Fingerprint Fee Was Received" for the I-485.
I'm a permanent resident if that plays a role here.
