    • Due to the extraordinary and unprecedented COVID-19 public health emergency, the production of certain Employment Authorization Documents (Form I-766, EAD) is delayed.  As a result, employees may use Form I-797, Notice of Action, with a Notice date on or after December 1, 2019 through and including August 20, 2020 informing an applicant of approval of an Application for Employment Authorization (Form I-765) as a Form I-9, Employment Eligibility Verification, List C #7 document that establishes employment authorization issued by the Department of Homeland Security pursuant to 8 C.F.R. 274a.2(b)(1)(v)(C)(7), even though the Notice states it is not evidence of employment authorization.  Employees may present their Form I-797 Notice of Action showing approval of their I-765 application as a list C document for Form I-9 compliance until December 1, 2020.

FYI: Up until December 1, 2020, we may present the NOA for the approval of EAD as evidence of authorisation.

All we need now is to push for an approval!

Not quite true. It only applies to cases approved up to and including the 20th August. Make sure to read the instructions from the website that you linked to. I think you'll be getting the EAD soon-ish anyway.

I still don’t get it...okay case (EAD) approved, now how can one work without SSN?

These people should do their job efficiently and stop making fun out of us. If they want to help us due to the setback from COVID-19, let them do something better than that pronouncement.

Granted none of us in this group has their EAD approved YET, I think we’re saying the same thing, isn’t it?

And YES - we can’t wait to get our EAD approved! That would be such a relief!

I want to believe that getting SSN when your EAD is approved is far easier than getting the EAD approved in the first place.

It says for cases approved by August 20, 2020. So if you receive approval on August 21, you won’t be able to use your approval notice as work authorization.

And personally, more than EAD, I want SSN so we can start building credit ASAP.

                    • Update:

My spouse completed biometrics. I am the primary applicant but still have not received biometrics interview notice.

I tried to walk in together with my spouse (both my lawyers and USCIS call center recommended to try it). They did not allow me to walk in. They checked my case together together with my spouse inside and it looked still not scheduled. They told my spouse that they do not allow anyone to walk in and they are surprised that USCIS call center recommended to try it.

                        • Hey all, I noticed that the processing time for I-131 at NBC has been updated and the current receipt date for a case inquiry is March 24, 2020. Do you think it's a valid step for us to submit a case inquiry (especially for those who haven't received a biometrics appt yet)? Or is it a pointless step as we are just going to get generic answers like to wait xxx days before making another inquiry?

A side note, there're some other threads who are reporting the processing time for I-765 is now 37 months. Not sure if the processing time can provide any relevant information at this point...

                          • Hi everyone,

Yes indeed this new processing time for I765 (only family based of course, otherwise it's less cruel) is quite a shock...

I don't know about the I-131, isn't it supposed to come as a combo card? I guess having at least the right to travel back to our families is better than nothing!! I think it's worth it to try at least to make an enquiry about it. I'll try that too.

On my side, I received a reply from the ombudsman's office three days ago saying they filed an enquiry on my case, but this was before the processing times were modified, and I have not heard back yet, neither seen any change on my case status.

My expedite for I765 has not been either approved or denied after 15 days and NBC has not sent my biometrics notices yet...
