  • Update: I just got an email about my I-765: New Card Is Being Produced!

My I-131 still shows "case was received", they didn't apply my biometrics apparently, so I'm not sure if I'll receive a combo card or just the EAD. I read that some people never got updates on their I-131 but ended up receiving the combo card anyways. I'll wait for my receipt(s) and I'll let you know! I still can't believe it!

      • My receipt date is March 26th, and right now the Websites says: Receipt date for a case inquiry: March 24th. I guess I just have to wait a couple days until I can submit a case inquiry?

Is it possible to file a request/enquiry even if the processing time for our EAD is now 28-37.5 months?

update : I see that it's possible via the I-131, not anymore for the I-765 (only those family based)

That’s great news! Congratulations! I see you’re adjusting from EB-2 and filed at TSC, so yours is within the processing time. But for us people, adjusting from B2, it might be a very long road ahead. Lol

                Thank you, Danny!
I'm actually adjusting from B1/B2 to EB2-NIW. My I-140 is at TSC, but my AOS forms are at the NBC, so I was really scared when I saw the new processing times yesterday! I'm certain that was a glitch and you'll see progress very soon!

What I said is online thing is telling you "your case is in normal processing time" and not letting you go through, while the rep created an inquiry for me.

Only option we have is to be annoying, you cannot bother online tool that is giving a dry NO-NO. I also have ongoing asylum case that they miraculously lost for 6 months and only thing that helped was that I have been religiously going to their office once a week, calling them, sending e-mails until they got tired of me and gave me a random receipt date that led to an EAD in 150 days.

This afternoon I filed an enquiry for I-131 for "outside normal processing time" through USCIS website...
I called them like 5 times over the last 2 weeks, spoke with them over live chat almost everyday and nothing happened.
I even filed for an expedite and still have no reply after 15 days!

I wrote to the ombudsman's office on 08/14, they came back to me on 08/19 saying they contacted USCIS about my case and will come back to me when they get a reply.... Nothing yet.

Hopefully something will happen, I need those biometrics

No, no expedite whatsoever. I considered it at first, because my AOS is employment based, so my spouse is also an immigrant, therefore no one was allowed to work in my household while I-765 wasn't approved. But my lawyer said that applying for financial hardship was too risky considering we had to prove we had assets on I-944. He didn't want to put us in a tight spot in the future, as this form is new and we don't know its weight for the final decision just yet.

I guess I was just lucky after having my first package rejected for "outdated forms" (that were not outdated), and then waiting almost 2 months to get the NOA receipts for the second package. I think they decided to spare me this time lol. Let's wait and see how long until they actually print and send the card. I really need it asap.

                            • Some encouraging news about the 70% staff furlough at USCIS!!!!
Last night, The Wall Street Journal reported that:
“House Passes Emergency Bill to Halt Immigration-Agency Cuts”

“The House on Saturday unanimously passed a bill to provide emergency funding to U.S. Citizenship and Immigration Services, the primary agency running the nation’s immigration system that is set to furlough roughly two-thirds of its employees at the end of this month.

The bill passed moments after the House voted on legislation to prevent cutbacks at the U.S. Postal Service, which brought members of Congress back to Washington for a rare Saturday session. Rep. Jamie Raskin (D., Md.) brought up the bill using a procedure known...” (read more at)

Hope the Senate don’t throw it under the table and let the furlough happen

                              • Great news. Though USCIS has plenty of money as is and does not need to rely on the senate. But they are run by Lego playing consultants. Agile and all.

Leahy Calls On USCIS To Delay Furlough Of 13,000 Dedicated Public Servants In Midst Of Pandemic

(TUESDAY, Aug. 18, 2020) -- Senate Appropriations Committee Vice Chairman Patrick Leahy (D-Vt.) Tuesday called on the U.S. Citizenship and Immigration Services (USCIS) to further delay the agency’s scheduled furlough of 13,000 public servants from August 30 to the end of the fiscal year.

Leahy wrote: “To put it more plainly, USCIS could pay all of its staff through the end of the fiscal year, avoid furloughs entirely, and still end the fiscal year with a sizeable carryover balance.”

In May, USCIS projected a shortfall in fiscal year 2020 of $571 million. However, revised estimates project a surplus of more than $230 million, giving USCIS ample funding to end the fiscal year without furloughing any public servants.

Leahy has pointed out that needlessly moving forward with the furlough would put thousands of dedicated public servants out of work at a time of record unemployment and in the middle of the pandemic. This would have ripple effects on communities across the country. Thousands of United States Citizens, employers, and students in Vermont and around the country rely on the work of USCIS and would be impacted by loss of services.
