  • I-751 Petition to Remove Conditions

    Hi Guys,

So I currently have my Green Card, I got it by applying and passing form I-485. It was a fun process and my wife & I worked really hard to make sure we pass with no red flags.
I live in New Jersey, and the nearest USCIS office is in Elizabeth.

It's been two years and our lawyer told us we have to apply for a "Petition to Remove Conditions" so my Green Card can be permanent. I am getting worried due to the whole COVID-19 and USCIS is currently down and not accepting any interviews. The reason why I am worried it's because I finally have a good job with a good income, and we are planning to buy a house once this whole thing is over, and I am worried that everything will be delayed and I will lose my job as well the money we saved. I spoke with my lawyer about this and he said the following:

    > We will send all the correct forms to avoid any Rejection, and we will send it exactly 90 days before expiration (June)

    > We will include evidence to avoid interviews due to the outbreak
    - Our I-485 interview, the I.O did state that we pass, but we will have 2nd interview after our two years. Our lawyer wants to avoid this due to COVID-19.

    > USCIS will send a letter within the first month to extend your Green Card you have now
    -
    Is this True?

I do trust our lawyer, however, I will feel a lot calmer if someone can share their story of this process. I know June is two months away and things can change, however, my wife & I would like to prepare ourselves for the worse, and maybe apply for additional things like a Work Permit.

Thank you for taking your time in reading this and thank you for sharing your story. Please do not hold back, as I said, we would like to prepare for worse.

You remain in conditional permanent resident status for as long as your I-751 is pending, no matter how long it takes. The I-751 receipt doubles as an extension letter, which, when combined with the expired green card, serves as proof of permanent residency (equivalent to a green card) for 18 months after the green card's expiration. If you lose the green card or your application is still pending at the end of the 18-month period, you can always get an appointment at a local USCIS office to get an I-551 stamp.

I wouldn't cut it so close at exactly 90 days; if it happens to be more than 90 days early it will be rejected. Wait a few days to make sure you are within the 90-day window.

It may be a year or so until the interview; the outbreak may not be an issue then.

This is my personal opinion and is not to be construed as legal advice.

      Thank You newacct!

I am not sure why our lawyer didn't mention that. I will say you mentioning how I remain in conditional permanent resident status for as long as your I-751 is pending, did bring joy to us.

Now the only thing we have to focus on is sending enough evidence to USCIS to avoid a 2nd interview. Our lawyer did say there is a 50/50 chance we will have an interview because we passed our first interview and they still have those evidence.
      - Not hiding anything, I just want this to be over with as soon as possible
