    I am a born in America Army veteran whom has always had a social security number.

    My recently married wife as of November 2019 is a Japanese lady whom has been in America since 2017 on a E2 work visa. She also has a US social security number due to her E2 work visa.

    her 17 year old daughter whom is now my step daughter has also been in America with her since 2017. She does not have a US social security number

    we have applied for green cards for both of them and the I-485 has been sent back twice. Quite frustrating as I'm sure many of you know.

    my wife's packet includes the following forms that have already been filled out..

    I-485
    I-864
    I-693
    I-130
    I-130A
    I-765 (eligibility catergory C09)
    I-131
    G-1145

    we have attached checks in the amount of $1225 for the I-485 and $535 for the I-130


    my step daughter's packet includes the following forms that have already been filled out..

    I-485
    I-864
    I-693
    I-130
    I-765 (eligibility catergory C09)
    I-131


    we have attached checks in the amount of $1225 for the I-485 and $535 for the I-130


    the reasons for denial for my wifes and step daughter's change of status green card packets are as follows...

    1-485 THE APPLICATION/PETITTION HAS NOT BEEN FULLY COMPLETED. BASED ON THE SELECTION MADE UNDER PART 2 APPLICATION TYPE OR FILING CATERGORY, THE FORM I-944 AND/OR FORM I-864/I-864EZ ARE REQUIRED

    1-130 YOUR I-130 FORM IS BEING RETURNED TO YOU BECAUSE THE ELIDGIBILITY YOU FILED UNDER REQUIRES THAT YOU FILE AN I-485 ALSO. PLEASE RESUBMIT BOTH FORMS AND THE APPTOPRIATE FEES IN ORDER TO CONTINUE PROCESSING.



    To say I'm confused is an understatement lol...

    I understand that they need this I-944 form that I've never heard of. Possibly an I-864ez as well?

    But why do they say I need an I-485 also? I've done one for my wife and one for my step daughter. Do I...As an American citizen also have to submit a I-485 for myself??

    is the elidgibility code of C09 the correct code to use?

    I'll stop there as I don't want to overwhelm any of you with questions.

    ANY help is greatly appreciated

      I got the same problem.

      My package was returned the first time for missing I-944 (I sent to FedEx before the deadline of not requiring I-944 but USCIS rejected)

      The second time I got the same notice as yours.

      1/Payment not provided
      2/ Missing I-944 and/or I-864/864EZ (which I think does not apply)

      It is really frustrating. I can't really figure out why it is like that !

      Have you tried calling USCIS or emailing them ? Any idea ?

        did you also file under ELIDGIBILITY code C09???

        did you have to do a I-485 for yourself and your spouse or is one only needed for your spouse.

        my rejection letter says that I have to submit one too but that seems strange as I'm an American citizen???

        thanks for any help and I will let you know what they say on phone call today

          I just called....

          all they did was confirm that C09 is the right ELIDGIBILITY code in my case and that the I-944 is a pretty new form..


          I'm feeling like a victim of circumstance here lol.

          the first time they sent it back a few months ago was because they said my i-485 was completed on an outdated form. Apparently they had recently updated it.

          now it gets sent back again because of this newish i-944 form...

          I hope it's really just this simple and they accept it this time.

          I've wasted $60 on mailing these packets twice so far

            Oh I got it. They does not mean you need an I-485.

            I think they mean your daughter and spouse need to submit I-485 and I-130 at the same time for concurrent filing.

                Any update in this case. I am in the same boat here. My case was rejected because I did not file I-864 but I checked box 62.a, page 14 of the I-485 which means I am exempt from filing I-864.
                05/08/20: I-485, I-765, I-131, I-944 sent to USCIS
                05/13 Rejected due to lack of I-864
                05/27 resubmitted with explanation
                06/03 Rejected again-same reason
                06/13 Resubmitted with I-864
                07/07 Lockbox emailed back and ask to resubmit
                07/09 Filings accepted with PD 05/08/20 (nice)
                08/06 Prior biometrics applied to I485
                08/28 Took biometrics for I-765 only
                09/28 I-765's Cards Ordered
                10/02 EAD/AP received
                04/12 Interview Sched
                05/11 Interview done approval on the spot but no USCIS update online

                  Hello I944 is a new form that took effect since February 2020. It is now required for the I485 application; it is no additional cost to file it but still re-check. I864 EZ was requested so send it as well.

                    I have some question, I hope someone can help me
                    I was on visitor visa in Canada, my visa ran out 6 months ago, my wife applied for me spouse green card and I got approval now, my case sent to NVC now, and now it’s time for interview, my concern is can I book the appointment in Canada while I don’t have legal status here or should I schedule my appointment in India.
