  • Re-filing after abandoning I-485?

    I've recently (less than 5 weeks ago) left the US with a pending I-485. Due to COVID I could not get emergency parole from USCIS. This according to all I've heard means my I-485 is abandoned. I have not gotten any mail or notice from USCIS indicating that yet.

    Best option is likely to return to US now (as spouse of US citizen travel ban does not affect me) and re-file. Has anyone here done this before?

    How do I notify USCIS of my intent to re-file if my abandoned 485 is still in their system?

    And do I have to re-file all documents (the whole package) with all fees, or is there some in-between option since I just filed in October 2019 and they still have my docs?
    We filed with joint sponsor, and it would for example be great not to put them through the whole paper mill again.

    Any insight is hugely appreciated!

    From what I read if they deny your I485 because you abandoned it, then you need to send a complete I485 with all the requirements, fees, forms and in your case even the new I944 form.

    You may have problems entering the USA with your current visa and be married to USC. Entering the USA with the idea to get a GC is an issue too.
