Replacement Form I-94 Nonimmigrant Arrival-Departure Document

  • Replacement Form I-94 Nonimmigrant Arrival-Departure Document

    I want to ask you if someone knows how important is that I-94 record. I have my old passport with 10 year visa, but I'm missing this paper that I filled in a airplane. I'm overstay, more than 10 years, and I wonder if passport number and visa number will be enough or should I file Form I-102, Application for Replacement/Initial Nonimmigrant Arrival-Departure Document for an additional fee of $445. Any had similar experiences. Thanks.

    try a freedom of information first, see if the info is on there. We did that but didn't have the info..... ended up doing the 102. where you had a 10 year visa maybe more info in your file. we found one in 2016 from 1994.

      Thanks a lot. I wonder if a a freedom of information cannot produce the number, but paying the fee for Form-102 can? The data should be at Customs and Border Patrol.

        Jonas8,

        I was in a situation last Spring where I couldn't locate my I-94 record online because the I-94 retrieval tool wasn't working for people who hadn't left the U.S. in over five years (that's now solved, by the way). I was able to eventually get a copy of it from my university (who'd had the foresight to keep a copy of it), but in the interim I'd gone to speak to a CBP officer at my local airport (who was able to get the number, but wouldn't print out a record for me). Not sure if that's an option for you given the overstay.

        The other option, also mentioned, was the FOIA request on yourself (which I did on myself for my I-94 number). Here's how long it took, as of last year: 1 month and 3 days. Pretty impressive, to be honest! Not sure if it'll work given the paper-based nature of your missing I-94. I did get a record of my I-94 numbers (well, everything post-2003).

          According to this section of the USCIS Policy Manual, if you don't have your I-94, an admission stamp in your passport can also serve as evidence of admission.

            My husband dad filled I-102, last year because he destroyed That Card. It’s costly but you have to fill that form.
            He arrived to USA in 2006. They located his I-94 and he received a GC 2 months ago.

              I ended up doing that. The admission stamp is more than enough in my opinion.

                  The i94 stamp is sufficient that is in the your passport. USCIS just needs the date you have arrived in the country and the date given for you to be in the USA.
