  • Returned papers for outdated I-485 form

    Hey everyone, I have a question, my AOS package got returned cause of outdated i-485 and they opened my I-693 medical exam. Do I need a new medical exam and to fill all the other papers again or I can just send it back with the updated I-485 and the same rest of papers.

    I am sorry that you had that experience. Just in case USCIS may have a lapse in memory and forgot that they were the ones who opened the I693, I would ask the doctor/receptionist that I visited prior, to repackage the medical results in a sealed envelop. If USCIS wrote on the results, I'd perhaps ask the medical official to re-write the info on a new form and re-package. Failing that, follow what the notice said you should do. All the best.

      Hello, and thank you for the respond. I called my doctor office and they were able to print and pack my papers again. I have another question I found out that I have to fill out and the form I-944. Can you tell me should I be the only one who provide assets or my husband also? And also about my credit record is it only for me or again and for my husband?

        I am happy that your doctor's office was able to re-pack the medical form for you; that was a good move. The application of adjustment of status includes several forms. I130, I130A, I131, G1145, G325A, I485, I693, I864, I765 and I944 (recent). The I 864 is an affidavit of support to show financial accountability and assets of each person within your household (you, your spouse and any other contributing party); this form is usually accompanied by other supporting documents such as tax return statements, pay advice etc.

        The I944 is a declaration of self-sufficiency (it is a form that assesses individual assets, mainly financial independence from varied US 'assistance'/benefit programs, earnings etc and the individual's education background). The form is to be primarily filled out by the immigrating individual (the alien- sorry, I hate that term). However, part 3 on the I944 form has extensive queries on your and your household member's assets, resources, and financial assets. If this section is accurately filled out with information for you and your husband's assets, then there is no need to fill out two separate forms. Also, the I944 requires supporting documentation of tax statements and other financial records for you and your husband. But, since you would have already attached those with the I864, the USCIS would not necessarily want to receive multiple copies of financial records ( I would still attach a set of my financial records).

        So the I944 is not required to be filled out by the US citizen/sponsoring spouse, but, just make sure that you accurately fill out all sections of PART 3 of I944 with information for both you and your husband's assets. Yes the credit record is only for you, the sections in I944 'Liabilities and Assets', 'Credit Report and Score questions 11-14 require information specifically about you the immigrant. However, if you get the credit score from a reputable agency, it would not hurt to get one for your husband and attach them both to the form. If any section within the form I944 does not apply to you or your family member type in or write in N/A.

        General advice-There is no individual or a show of single asset when initially filing for adjustment of status; there will always be sections that will require information for the immigrant and his or her spouse. So everything that you submit at this stage MUST show information on financial assets etc for you and your husband/spouse. The option of filing or submitting documents by yourself is only at the removal of conditions stage, which is within 90days before the 2 years anniversary of receiving the first Green card, but, even then removing status as an individual has to be done with a waiver, based on cruelty, death etc of the sponsoring spouse. So ALWAYS default to showing BOTH your assets in every single form where that information is required.

          Also, I have some questions about I-944. So the question from part 3 total income, am I supposed to put our joint income since we filled taxes together or just mine from my w-2? And my second question is about our assets.... so we only have bank checking accounts and I wonder how many monthly statement from the bank should I get? Just one month back, 3 , 12... Thank you for your help I really appreciate it!

            Your question 1:
            Am I supposed to put our joint income since we filled taxes together or just mine from my w-2?

            Response: I944 -Household Income- question 1-page 3 requires your individual total income, yes from W-2, not your joint income. You should also fill out your husband's individual total income, not the joint income in one of the other sections under Household Income- page 3, form I944.


            Your question 2: How many monthly statement from the bank should I get?

            Response: I would submit no less than 6 mths- 1 year 's worth (or more) of bank statements. Some persons usually submit 3-4 of the most recent bank statements. However, I usually prefer giving USCIS substantial proof of anything they require, which is usually by submitting extensive amount of evidence.

                Hi there,
                I have a question about the form I-485 question 61, as my answer is no, the instruction says to proceed to 62a, but I do not fall under any of those categories. Can I leave it blank and move to 63a?
