  • How long it takes for EAD card renewal for I-485 based

    Hi folks,

I hope everyone stays safe and healthy!

My NYC interview got canceled (and my medical exam taken this year went void) and now just filed my EAD card renewal...

Does anyone know how long it takes for EAD renewal? I know it is not urgent for me since my card will expire in October but just a concern since I might change the employer later this year and afraid that the 180-extension period could not apply to different employment than my current one...

Will it be a fast process since I send the last EAD receipt for this renewal application (given the receipt shows something like "if you include this letter in the application, it will take less time)...

    Thanks for any color!!!!!!!!!!!!!!!!!!!!!!!!!!!!

    ---------------------------------------------------------------------------------------------------------------------------------------

    My timeline:

I-130 filed February 2018 (marriage to a permanent resident)
    I-485/I-131/I-765 filed May 2019
Expediated request for EAD due to ongoing employment (previous F-1 using OPT) October 2019
Got my combo card October 2019
Interview scheduled for April 2019 in NYC
Interview canceled due to the pandemic
    EAD renewal filed May 2019

Your employment authorization is automatically extended for 180 days after the expiration date of your EAD. It doesn't matter if you change employers or start a new job in the extension period. It will be like you have a valid EAD during the extension period.

This is my personal opinion and is not to be construed as legal advice.

      1. why do you say that your medical exam went void? If you did the medical this year, it will be valid until 2022. Maybe you are confusing the 60 day restriction when it is done before sending the I-485 package.
      2. the EAD renewal could take 1 month or more, even 10 months in some cases. Your 180 extension start in October, so don't worry, I bet you will get your new EAD before April 2021.
Nov 2018 - Package sent - EB - Texas Service Center
Day 1 - Package received at the lockbox
Day 999 - Card delivered to me - Aug 2021

        Thank you!

        1. I did my medical exam and was about to bring it to my interview.....my attorney said that will be only valid for 60 days...she said bringing the sealed results to interview is considered as submission of medical results...

        2. Wow! 1 month would be great! I just hope I can change job even after October!

        Thanks!

Well your lawyer is wrong: https://www.uscis.gov/news/alerts/uscis-policy-manual-update
The updated policy, which goes into effect on Nov. 1, 2018, will require applicants to submit a Form I-693 that is signed by a civil surgeon no more than 60 days before filing the underlying application for an immigration benefit

So your medical is after you filed your application. People get "courtesy letters" all the time that are more than 60 days before the interview, they do the medical and go to the interview 3 or more months later and give the sealed envelope without problems.

            It is clear here: https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-4

Yes, you are submitting the medical but after your I-485 and after November 1, 2018. It is 60 days before submitting the underlying benefit application (I-485), there is no restriction to submit it after.

Of course the officer can ask you for a new one if they want, but your medical is valid for 2 years and not 60 days.
