  • EAD -for pending i-485- confusion (URGENT!!!)

    Hi,

I've been working with my EAD (c(5) category, I'm currently a J2 holder). This is my second EAD with the same category and it expires on June 15. I've never required for fingerprint for my EADs before. I've submitted my i-765 (alongside i-485 and i-131) on Feb 19th. I'm very nervous that I might not be able to receive my new EAD by before my current EAD expires (June 15). I was wondering if I can continue working since I submitted my application in a timely manner.

Otherwise, should I try to expedite the process at USCIS?

    Thanks.

NO, You cannot work with a pending EAD application. You need to stop working / take a leave of absence till the new EAD is received.

EAD is based on a pending I-485 and therefore you won't lose your status in the US even if the EAD expires.

EAD renewals can be sent to USCIS 180 days before the current one expires. Is there a reason you waited so long ?

(C)(5) is unfortunately not included in the auto 180-day extension: https://www.uscis.gov/i-9-central/44...-circumstances

Unless I’m missing something, you’ll have to expedite.

          Thanks.
Our embassy screwed our two-year rule (for J visa) waiver documents last year which caused an administrative disruption. Because of the delay, I was able to submit on Feb 19 and we can't extend our current visa because of the waiver.

Thanks for your answer by the way.

Another question: what is the proper way for the expedite request? What documents do I need to collect? How should I send them to USCIS? Is there a guideline or any resource that you can refer to?

          Best.
