  • EB-2 India PD current in June (Final Action Date). What happens next?

    My PD is June 5, 2009. EB-2 India. I filed my I-485, I-131, I-765 back in Nov and received my combo card in February. Now the final action date is current in June. So what should I expect to happen in June? I already submitted my medical along with my 485 application. No RFEs received, yet. Anything specific I should be looking for?

    I am planning to change employers. Can I do so safely on my EAD? What happens if I don't get my GC by the time my EAD expires (Feb 2021)?

    11/5/19 I-485, I-485 J, I-765, I-131 receipt
    11/30/19 Biometrics notice
    12/13/19 Biometrics done.
    2/25/20 EAD sent to production.
    2/26/20 131 approved
    2/27/20 Ready to be scheduled for interview. EAD shipped
    3/2/20 EAD combo card in hand
    3/5/20 fingerprints applied to 131
    3/26/20 Interview Cancelled (Never scheduled)
    7/30/20 New card is being produced
    7/31/20 I-485, I-485J Status changed to Case Approved
    8/7/20 Received I-797C for 485 and 485J
    8/19/20 Card was mailed to me
    8/22/20 GC in hand

    Final action date means USCIS reviews your I-485 in detail and assuming visa numbers are available, approve your I-485
    To change employers:
    Your I-485 should have been pending for 180 days.
    Your new job should be very similar to what you are currently doing. Even better if it is in the same geographical area
    You will need your new company / attorney to file an AC21 prior to joining them.

    Yes, you can use your EAD for the new employer. You can also apply to renew them yourself.

      Great. Thank you. Can I still transfer my H1B to the new employer and be on H1B just to be on the safe side?

        Yes, but if you decide to do an H1 transfer, DO NOT use the EAD
        Once you use EAD, you cannot go back to H1
