I-765 RFE, I don't have the requested information.

  • I-765 RFE, I don't have the requested information.

    I got an RFE for my I-765 renewal. They are asking me to provide evidence that I am in removal proceedings and that my I-485 was terminated (the date they gave for the termination was 1+ yrs prior to the I-485 receipt date, I wasn't even married on that date).
    I am not in removal proceedings and a call to USCIS confirmed that my I-485 is still pending.
    USCIS officer told me that the termination date must have been in error and that I should send all evidence that shows that I am qualified to get an EAD...which is what I initially sent for my renewal. Is that going to be enough?
    Also, should I include the original yellow letter or a copy of it with my documents?

    I would send them a copy of the I130 and 1485 I797C with a letter outlining that you are not in removal proceedings. Don't EVER send originals to the government, they are notorious for losing documents.

      Thanks, I will include all documents I have. Someone else suggested I-130 too. I hadn't thought to include that...Thank you.
