RFE for birth certificate, which was 100% included with original application

  • RFE for birth certificate, which was 100% included with original application

    Is it possible they overlooked it? It's asking for birth certificate and we 100% sent a copy the first time along with a certified translation. Do we just send it again? Or how do we find out what needs to be different? The letter is vague and if you call them they just say they can't answer questions and to hire an attorney if you're confused

    That is very strange, I mean, what does the letter say? I will send one more time ASAP if I was in your shoes.

      It says:

      "
      What you need to do

      You must provide the following information for us to make a final decision on your case. Please include a copy of ALL pages of this letter with your response
      • Submit a copy of the birth certificate or other primary birth record issued by the appropriate civil authority for the applicant. USCIS will only accept a long-form birth certificate which lists at least one parent. If the birth certificate or other primary birth record is not available, you must submit acceptable secondary evidence AND a letter from the government or other authority. Examples of acceptable secondary evidence may include, but is not limited to:church or school records, listing your parents' names and your date of birth; hospital records of your birth; or other official records indicating a country and record of birth.

      Title 8 Code of Federal Regulations, Section 103.2(b)(2(ii) states:

      "Where are record does not exist, the applicant or petitioner must submit an original written statement on government letterhead establishing this from the relevant government or other authority. The statement must indicate the reason the record does not exist, and indicate whether similar records for the time and place are available."


      It must contain one of the following:
      A legible seal
      A legible stamp
      A signature with a title containing the words: secretary, registrar or births and deaths

      If the document is in a language other than English, you must submit a copy of the foreign language document and a completed English translation. For more information on birth records, see visa reciprocity and civil documents at https://travel.state.gov.

      We 100% submitted a copy of her birth certificate that did have a seal. And we included a certified translation.

        We received the same RFE asking for birth certificate back in March. We replied to it with the same copy as what we had included in our original submission package. Our case now is waiting for the interview to be scheduled.

            Can you check if your birth is registered within 12 months of Birth? They don't accept Birth certificates if it's registered after 12 months. You have to submit any secondary evidence if that's the case.

              I received the same exact RFE even though my lawyer included the birth certificate for both of us. However, they asked some other documents too though so my lawyer is just going to send the old ones again with additional documents. However, make that your birth certificate is a legible seal or so on it to make it valid.

                Why don't you contact support at tnesevai tnega? There should also be points where you will find how to get permission directly. I'm sure that either an employee will help you in the chat, an email, or a hotline for online calls. Have you looked at these options? I think that nothing is impossible. Anyone can achieve anything. Just call there from morning to evening if there is no answer. In such situations, self-confidence and stubbornness help a lot. And it is better to write emails.
