    Hello

    I would like to add my timeline on I751-Removal of Conditions (ROC) on Permanent Residence to this platform (I will update the info as things progress). But first, here is a tad bit of background information on my immigration journey.

    My US immigration story started in 2014 as J1-cultural exchange teacher. I applied for J1 waiver in November 2015 got it in April 2016. In June 2017, I got married to my darling who happened to be a US citizen and we applied for I485-adjustment of status (AOS) based on marriage, two weeks after the marriage (important info for those who think that they should wait to apply for AOS). Also note that our initial application for I485 was done within my 30-day post completion period after the J1 expired. Each J1 candidate who successfully completes the term in J1 status receives a month to vacate the country.

    If your immigration status is current and will be for a good while, then by all means wait as long as you legally can to apply for adjustment of status, that way if you apply after 2 solid years of marriage you will get a full 10 yr green card and avoid the ROC stage. But let's continue, so I received EAD in October 2017, then green card (I551) after interview in July 2018. IMPORTANTLY, we did not leave the US until I received the actual green card.

Our initial I485 -adjustment of status (AOS) package sent on July 18, 2017 included I130, I131, I485, I864, I765, I693, G1145, and G325A; please add I944 form and any other current forms necessary to your package. This now brings me to our current immigration process, the I751, which we filed jointly within the 90 days before it expired. Since our on the spot approval of I485 on July 31, 2018 (date of interview and green card) we have been meticulously collecting evidence that we knew we'll need for our ROC. Please see the list of what we submitted below.

    I751-ROC Timeline

    Mailed Package: On May 4, 2020, approximately 89 days prior to the expiration (July 31, 2020) of my existing green card we mailed 9lbs 5.8 oz of evidence with the application to Phoenix lockbox.

    USCIS Text: On May 26, 2020 (about 3 weeks) I received a single text from USCIS that indicated that my case was received, the receipt number and that I am to expect an official receipt notice form I797 in mail. I immediately entered the receipt number from the text in USCIS check case online and saw the same information as seen in the text, but with a bit more detail which indicated the date of when they received the package as May 6, 2020 (USPS delivery date). It also outlined that the form I797 will indicate how they will proceed with the case/application.

    NOTE: We have not received any RFEs at any stage in any of the immigration application procedures mentioned above. We strongly encourage all applicants to do their best to submit fully completed and signed application form(s) with substantial evidence and make a solid, professional first impression from the first package mailed to USCIS.

      • Copy of our auto loan agreement for the other (Both our names are on the loan agreement)
      • Copies of bill of purchase for our 2 cars (we made sure both of our names were on these documents as well)
      • Copies of our auto loan (payment (2019-2020) made out of both of our accounts
      • Copies of vehicle maintenance bills (2017-2020) showing we both paid bills on each other's car (i.e. hubby's name on auto-shop form as the owner and wife's name on the credit card receipt paying the bill).
    • Our Medical Insurance Policies & Cards:
    • Copies of our Health, Dental insurance (2017-2020) showing both of us on each other's insurance plan as spouses/
    • Our Employment Contracts showing that we are registered as emergency contacts and spouses in our employment paperwork.
    • A photo album of our relationship through the years with photo-copies of mementos (such as plane and event tickets) to verify various events.
    • Copies of mailed envelopes and greeting cards received from friends and family and cards given to each other showing evidence that we are living together as a married couple at the same address and also that our friends as well as businesses know this and address mail to both of us.

        1797C Receipt Notice is finally here

        If anything this wait on the receipt taught us a few lessons.

        Lesson 1. Approach USCIS with full business like manner.
        Lesson 2. Follow up with USPS and the expected delivery time to estimate when communication from USCIS should be received.
        Lesson 3. IGNORE the USCIS time frame given to contact them re: processing time, unreceived notices etc
        Lesson 4. Be proactive, call, email, open case enquiry as is necessary.

        I751 Journey-So Far

        May 4, 2020- Priority Mail sent with application and supporting evidence (over 9lbs)
        May 6, 2020- Priority Mail received at Phoenix Lockbox
        May 26, 2020- Received USCIS text message of acceptance with receipt number with promise of actual receipt in mail.
        May 26- June 5, 2020 - The wait for actual receipt -something is wrong.
        June 5, 2020 -Emailed lock box and opened a case enquiry for non-receipt of notice- their expected response June 27, 2020
        June 15, 2020- Case inquiry answered with detail in email of USCIS investigation into the unreceived notice; they sent the receipt on May 26 to the physical and not mailing address and got undeliverable (even after we sent copious documents with the expected mailing address) geesh.
        June 15, 2020- a 'Just in case' call to USCIS customer service to speak with a human and be certain that they used the mailing and not physical address to resend the notice.
        June 22, 2020- Notice received. FINALLY

        Now we will periodically check for updates on USCIS online Check status etc and wait until they send the other documents. On the back of the receipt they made it clear that they can investigate any public records, internet, mails etc and visit where we live to obtain as much proof as they can to support their final decision on the case.
