    Hi,
    first of all, I’m just gonna give a brief history on my case. Initially I was a employment based petition my first employer was already closed so my current employer right now (told me that they will be the petitioner) however my AOS it’s been almost four years since I the status change from RFE to documents received and then my current employer change the status to (name was changed). First question this current employer should have ported my petition in the first place they hire me right? I asked them and they told me that we don’t need to do that it’s just because the company will petition you as per my current employer Is that possible that instead of porting they will just petition me? I’ve been working with them for 2 years and I’ve been renewing my EAD since then I worked with them and my EAD still current and will expire next year 2021. Now me and my wife (green card holder) decided to go to another path of filing the petition through marriage based we just recently submitted the applications and the NBC already accepted it and we do have the receipt notices and just waiting for the next step. Question for this new scenario of my application. Am I allowed to work with using my EAD from employment based petition to work on other company since my current employer does not have my clear answers on my case status on employment base. Is that still legal to work on other company while I’m waiting for the next step for my family based petition which is doing biometrics and which we do have receipt notices already from family based petition but no EAD yet from that application ( in short my current employer who petitioned me have no clear answer on what’s happening to my case status on my pending AOS to them was since 2017 nothing change). Hopefully someone can help me with my case and would definitely appreciate any kind of suggestions thanks and have a good day guys.
