  • F2A Category and green card while in US

    Hi guys,

can anyone please tell me, if a person with green card married a woman with a baby and now sending his package. How many I-130 and I-485 he needs to send, 1 of each form for each family member, or only I-130 and I-485 for mother only. Because in the instruction it says if you are green card holder you can list your children in parents form and don't need to file another I-130. little confusing. Thank you all.

One I-130 for the woman is sufficient. The baby can immigrate as her derivative beneficiary. Both of them need I-485s if they are doing Adjustment of Status in the US.

But if the petitioner is going to naturalize before they immigrate, then they would need to file two I-130s.

This is my personal opinion and is not to be construed as legal advice.

Thank you very much for your answer. I am sorry I wasn't able to thank you earlier.
