I-485 Rejected for missing forms (which we had submitted, USCIS error?)

  • I-485 Rejected for missing forms (which we had submitted, USCIS error?)

    Last week, we submitted a I-485 (related to an online submitted I-130). Today, we received our paperwork back with rejection for missing form I-944 and/or I-864. We had submitted both of these forms, included them in the TOC and written their numbers on the envelope.

    We have no clue why it was rejected. The phone support didn't know either, and also couldn't access the rejection letter... seems like it didn't make it into the USCIS systems fully? The phone support also had expected the notice would contain an email address for the lockbox, but it didn't.

    We also had submitted a I-693 medical form. It's now unsealed, though the lockbox did print a page ID on the bottom of each sheet, so I'm wondering if we can just resubmit it since it's already been tagged/scanned?

    In terms of processing time, USPS delivered our packet Wednesday last week (20 may). The rejection notice is dated 22 May. With the holiday on Monday, we got our packet back five business days later. No email/SMS notices were sent, even though we did submit G-1145.

    The USCIS eRequest isn't helpful since we don't fall within any of its categories. Instead, we tried using the "myUSCIS" help request, but tagged the message as associated with our online I-130 request (it seems that only submitted requests can get help through that website). Maybe we should also submit an eRequest filed under the wrong category for help?

    We're about to contact a lawyer to help us.... I'm expecting our action to be to resubmit everything, just as they returned it, with a note saying that we have the forms.

    online I-130 (receipt dated 7 May 2020) and I-485 (filed 3 June 2020, receipt dated 26 June ). RFIE (birth-certificate) delayed petition ~20 days. I-693 Deficiency notice received (1 Aug 2020). Waiting for biometrics notice (Indianapolis).

    Addendum:

    myUSCIS (promptly, within an hour) responded that they can't help me through myUSCIS.

    I later found an email address for the USCIS lockbox support, and am now waiting for their response.

    Another addendum:
    I wonder if we're missing some evidence? Though in that case, I'd have expected a RFE.
    I also now see Another Case where the same reason was given, but in that case the I-944 wasn't submitted.

      Did you notice that your form 864 was expired. You should check that you also have updated forms for all of your forms with what's accepted by USCIS online. That might be one of your issues.

        Alas,

        That's the issue.

        I had the updated form, but printed the old one, and didn't double-check.

        Now to resubmit....

          Well, duh!

          1)Your form expired on 03/31/2020, I never understood why people can't get these forms from the USCIS website directly.

          2)Your form is incomplete, you need to fill it out properly.

          If you're doing this by yourself, be very careful, you don't want your application to be denied.

            This is why getting an attorney to review the paperwork is important. My wife (USC) and I retained an attorney to review our I485 and I751 and his consul has been invaluable and saved us countless stress. He ensured that what we sent to USCIS was perfect and error-free. I was approved for the I485 in just over 90 days back in 2018.

              I have all our forms filled out already (same sex marriage here) and I am confident we did it correctly. How much did they charge you for just reviewing them?

                We paid about $500 for the i-485 review, $500 for the i-751 review and will pay $500 for the N-400.

                  Nice, the lawyer I found charged me $500 to review them all. I had carefully filled them out. I brought them to him and he said everything looks fine. I'm about to send them over to the Lockbox next week.
