    Yep, I can still apply AOS once I’m out of status. My husband has found a immigration lawyer, we will have a consultation with lawyer soon.

    08/05/2020 AOS packages sent out to Chicago lockbox (130, 130A, 485, 131, 765, 864)
    08/24/2020 AOS application fee check was cashed by USCIS
    08/27/2020 Received 4 case Nos. 08/31/2020 Received I797C receipts in mail
    09/17/2020 Received yellow courtesy letter telling medical exam form is missing.
    11/13/2020 Received RFE for I944
    11/20/2020 USCIS received response to I944 RFE
    5/7/2021 USCIS sent out bio appointment to my address. Bio appointment in June 1 2021.

              Updated my timeline. Still waiting for my bio-metric appointment. Though I noticed I'm getting a letter from my lawyer today, so I'm wondering if that could be it, or something relating to my case

                After a long wait, I got my NOA1 for my documents today. However, still my checks are not cashed (hope it will get cashed without an issue).

                  ShanG they don't actually cash the checks; instead it gets converted into an electronic funds transfer (ACH debit) as described below:

                  Authorization for an Electronic Funds Transfer: By submitting your check, you authorize us to convert your check into an electronic fund transfer. We will use the account information from your check to make an electronic fund transfer from your checking account for the amount of the check. If the transfer cannot occur for technical reasons, you authorize us to process the copy of your original check through normal paper check procedures.

                    Anyone knows if I can enroll for Obama care or that might effect our case because of public charge rule? Our lawyer is advising us to not apply for obama care but I cant find any other affordable options for insurance.

                      How about if you were to look up healthcare plans using the Healthcare.gov website, but then buy the insurance policy directly from the company? That's what we did; we bought our health insurance directly from Blue Shield of California, but I originally found that insurance plan through the Healthcare.gov website. As a bonus, it was $15/mo cheaper to buy it directly from the company instead of through the Covered California marketplace.

                        As an immediate relative of a US Citizen, you can apply even if B-2 authorised stay expires, so what the folks are telling you is correct. Here is the official rule that should help you feel relieved about this situation (read the section for Immediate Relatives)

                          Do not apply for Obamacare because it will be considered as public assistance under Public Charge Rule. We went with “insubuy.com,” found it on immihelp’s website. Around $350/year for basic coverage and $700/year for a very good plan.

                            You are not overstaying as long your I-485 is pending given you are directly related to a USC. And if your application gets denied for whatever reason then just apply again, but DO NOT go back. If you do, you will definitely get denied the next time you apply on B2.

                                6/25/20 - sent
                                6/27/20 - arrived in Chicago Lockbox
                                7/13 - payment processed
                                7/15 - received 4 text notification (130,131,765, fingerprinting fee).

                                I filed I-130, I-485, I-765, I-864, I-944 and I-693 concurrently. F1 OPT, married to USC.

                                Questions:
                                • I didnt get a notification for I-485 but I did have a notification for “Finger printing fee was received”. Is this normal? Am i to expect another notification specifically for I-485? They did process 2 charges (I oaid by credit card). payment 1 for 130 and payment 2 for both I485 and finger printing fee.
                                • My EAD (via F1 OPT) will expire in September. Given my timeline above, how soon can I request for my EAD renewal to be expedited? From what I understand, I don’t qualify for automatic EAD extension since the category will change on the new EAD.
