    Hello,

    Due to family emergency (death of a family member), my parents wish to temporarily leave US to South Korea for funeral.

    I was wondering if there are any problems of re entering US.

    We currently have our combo card with approved advanced parole on our EAD card. We do not have any criminal activity (drug, etc) on our record. However, we were once denied I-485 before (different I-485 from the combo card we are approved with) and we are now overstaying with our E-2 visa expired.

    I apologize for the urgency but please help us as soon as possible.

    Please share us your experience for any advice. I have contacted our lawyer but we have yet received an answer.

    I have never read a post where someone said that they were denied entry to the USA with a valid/unexpired EAD/AP (combo) card. This doesn't mean that it can't happen, just that it must be very rare.

    I don't know the flight restrictions due to Covid19. I think that is more important or could present more problems than the valid combo card.

      When you say "overstaying with E2 visa expired", does it mean that I-485 is pending, you have a valid EAD/AP card and the E2 visa sticker on the passport has expired ?

        Yes, to be exact we have B-1 visa sticker on our passport, and then we ended up changing our status to E-1/E-2 in US so we do not have the E-1/E-2 sticker on the passport since we were physically in US when it was given to us.

          To sum it up, you came to the US on B1/B@ (visa on passport), then change of status to E1/E2 & filed for I-485.
          This is not overstaying and there is no need to have E1/E2 on passport. That sticker is only to enter the US.

          Since your latest I-485 is pending and your EAD/AP was the outcome of this pending application, you can travel without any issues.
