I originally entered the country on a TN-1 visa as a Canadian citizen. I married an American citizen, filed my I-485, went through the interview and everything was fine. The officer was prepared to stamp my passport if not for the fact that we did not bring my wife's original divorce decree. I was told that I needed to bring that by in person because it has a judge's seal on it.
I did this, was told by the woman in the Philadelphia office that everything was set and that I'd get something in the mail. What I got was a denial on the application for failure to provide proof of my wife's divorce. My wife immediately filed an appeal.
The appeal was filed in March of this year. On multiple subsequent visits to the immigration office, it doesn't appear that my case has moved anywhere. Further, there is apparently no expected timeline for the processing of appeals. I am told that I cannot get anymore advanced parole or EAD documents while in this state.
I am interested in any information anyone has on the appeals process. I am under the impression that involving my local congress representatives *changes* the track that my case follows but I don't know for certain that it's better. My wife and I are expecting a child in 2 months and I simply cannot afford not to work for some completely unknown amount of time.
