    I have been married for 18 months plus, how do I qualify for a non condition adjustment of status? Any help would be appreciated thanks.

    By non-conditional green card do you mean you prefer to wait to apply after 2 years-24 months of marriage so you could get a 10 year green card?
    Well that is a brilliant but somewhat risky idea. So essentially you have 6 months left to go to qualify for a 'non-conditional green card'. If you apply now it is hardly likely that your biometrics and interview will be fully processed so you will very well get the 10 yr green card; providing that you have substantial evidence to support your bonafide marriage and a successful interview. However, as you wait, is your visa status or legal presence in the USA compromised or are you bordering on being an illegal immigrant? If not, then go ahead and apply at least in your 22/23 month of marriage (just to be sure that you get your documents in). During this time start putting your extensive documents, application fee, forms etc together. There at least about 7-9 forms now applicable with the I485 adjustment of status. Here are links to how others on immihelp organized their forms and evidence. Please remember that since February 2020, I944 is a required form.

      Thanks you so much for taking the time to reply me, actually I have been happily married for 21 Months NOT 18 months, So with the 21 months do you think I can go ahead and submit my applications or I have to exactly wait for the whole 24 months inorder to start my application.

        No, you do not have to wait until you have been married for 2 years to file your application. What matters is whether you have been married for 2 years on the day you become a permanent resident (which in the case of someone doing Adjustment of Status is when the AOS is approved). Even if you file AOS the day after you married, if your application happens to be pending for so long that it is approved after you have been married for 2 years, you become a non-conditional permanent resident. Of course, it is unusual for AOS to take 2 years. The length of time AOS is pending is unpredictable and not under your control, but it will usually take at least a few months. If you file now, you are taking a gamble that it will take more than 3 months to approve, which, in recent years, is a pretty safe bet.

          You are most welcome. I would go ahead and apply. All being well with a successful process (superbly completed forms, fee, no RFE, RFIE, excellent interview etc) you should get your 10 -year Green card. You do not have to wait on the exact 24 months. There are stages in the entire process which would not or may not be completed before the 3 months until your 24 months of marriage so you have nothing to lose. All the best.
