  • I-485 with the birth certificate from Soviet Union

    Hi,

My mother wants to adjust her status and file I-485 through me (the US citizen child). We so far consulted only with one lawyer and he informed us that my mothers original birth certificate that was issued in 1961 when Kazakhstan (my mother's country of citizenship) was still part of Soviet Union is not going to work. Since the collapse of the USSR, Kazakhstan issues different birth certificate that is blue with hard cover. My mother never changed her old one, since she didn't have to, her current passport was issued with her old birth certificate too. So now the lawyer never dealt with Kazakhstan birth certificate, but he is saying our case has a high chance of denial if we apply with her old, original one. Now, in Kazakhstan it is impossible to her a new one, because of Covid-19 and everything being in lockdown. My mother is in the US and she cannot just go and apply either.
I am going to seek a second opinion next week, but in the meantime I would like to hear if anyone who filed I-485 from Kazakhstan with an old, original birth certificate issued by the USSR and if everything worked out fine?
I asked multiple lawyers who represented clients from Russia, Ukraine and they said that the old birth certificate worked fine with their clients. But none of them are from Kazakhstan. Thank you.
