485 for parent has RFE

  • 485 for parent has RFE

    1)Late registered birth certificate,20 years after. They ask for school leaving cert;(I have 10th grade graduation only);
    2)Proof name change of one parent, different name on his passport than my birth certificate. Neve changed name officially. They ask for proof of both the names belong to same person(my birth certificate does not have his last name but his passport has the last name).
    Due to corona, many offices schools closed, please help and advise.

    • Which country was beneficiary born in?
    • What is the date and year of birth?
    • Have they specifically asked for school leaving certificate or provided some other options?
    • Does beneficiary have other IDs showing birth date?
    • Is it possible for you to get affidavits from beneficiary’s parents/close relative?
    Please also update with your timeline - when you submitted forms, receipt date, etc.

        1) born in india
        2)year in 1959
        3)They asked for petitioners either religious revord( have none), school leaving certificate( have 10th pass marksheet and character showing my dob with only one parent name).
        4) beneficiary has aadhar card under my birth certificate name but the passport has last name, which is missing in the aadhar card.
        5) only 1 relative close sibling present, 2nd can get from a friend, will it work?
        suggestions.

          Also the parent whose last name is different on the passport and that parent’s birth certificate. It holds same thing about that paren’s name for my birth certificate along with 10th grade mark sheet.

              Thanks a lot for the info. In the secondary evidence I have my parent’s PAN card same name as on my birthdate certificate.
              1)you think this along with 2 affidavits should work to prove relationship to the parent? The rfe asked prove suresh kumar and suresh kumar arora are both the same people.(My birth certificate has Suresh Kumar and no last name).
              2) I can prove for the second rfe by submitting school record.

                Hi,
                I updated my answer above with more links. Please read them, I think they will help. There is one sample affidavit to show that different names belong to the same person. Personally, I’d provide multiple documents in the response - self affidavits as per the links above, affidavits from others confirming the information and also whatever more secondary evidence I can (Aadhar, PAN, Driving License, phone, water bill etc.)

                    Well had a b1 visa but right now not in us. Do you think it’s best to get the docs submitted from an attorney or no need? I am only concerned if I have to make any appeals, then may need one. Suggestions?

                      Frankly, I think its a matter of personal preference and how comfortable you feel with the requirements and documentation they need. It involves reading all the requirements in detail and preparing documentation and foreseeing any possible objections and addressing them proactively. If you are not feeling confident/prepared with all this or might not have sufficient time to do this, I would definitely recommend getting services of an attorney. Also, it might be possible to add an attorney at later stage also in some cases also if expert representation is needed.

                          Well that’s all a very good help and advice. Appreciate it. If have to look for a good attorney, what suggestions you have? Don’t know any and moreover cannot go for google reviews . Things to ask an attorney may be before selecting one? Any suggestions?
