    We did include the original copy and the certified translation.

    The RFIE asks for an original copy that contains one of the following:
    • A legible seal
    • A legible stamp
    • A signature with a title containing the words: secretary, registrar or births and deaths

    The seals and stamps on the original are illegible; all documents from the country have been digitized. So there is no way to get a clearer document - it doesn't exist. There's a sticker on the original that means it was digitized but it doesn't specifically spell that out.

    Very frustrated...

      Are you working with a lawyer? What did he say?
      I would suggest that your print out a copy of the digitized version and also a article/notice from the home country stating that all birth certificates have been digitized after a certain date.

      Does your original birth certificate not have a signature from a registrar or secretary?

        Patience, grasshopper! There is a solution for everything and you have until (due date on RFE + 60 calendar days) to get back to them.

        Some options you can look into (more than one can apply):
        1. (Best option) Ask the issuing authority to provide an updated document that meets one of the criteria above, or have the issuing authority provide a description about the digitization process and how it is expected that some documents could have illegible information.
        2. Use a professional translation company. They would need to list everything on the original in the translation also and certify that it is correct.
        3. Additionally, provide secondary evidence of the birth (e.g. matriculation certificate and other government-issued identification documents listing date of birth depending on the country. e.g. for India this could be Aadhar card, PAN card, driving license, passport, etc.)
        4. Additionally, provide atleast 2 affidavits from individuals closely related to the person, older and familiar with the birth. You can review these links for descriptions and sample affidavits:

          I see you got the boimetrics notice today?
          Was it in normal mail or email or both?
          And did the online status change too?

                I had biometrics last week. You will receive mail in your mailbox. Online status is not going to change till a day after your biometrics.

                  • How long would you all suggest before trying to send the application again? Counting the days here, past 30 days and no info about payment clearance, no text messages, emails etc.

                        I would like to ask for your help on my case.

                        I'm currently working under OPT, and my EAD will expire on 1/1/2021. I married to my wife, a PR, in June, and we concurrently filed I-130, I-485 and I-765 on 7/7/2020. My wife had $10K income in 2019, so I file form I-864 to show my additional income of $23K. Thus, our income is beyond the threshold line.

                        I receive NOAs for all of them on 8/2/20, and the PD for I-130 and I-485 is 7/13/20

                        On 8/5/2020, I received a ASC Appointment Notice for Biometrics for form I-485 and I-765, and the appointment will be on 8/19/20.

                        On 8/8/2020, I received a Request for Initial Evidence for form I-485. They want us to show that my income was from a lawful source and was earned while I was authorized to work in the United States. They listed several examples of documents that they want us to provide:
                        • A copy of an unexpired Form I-94, Arrival/Departure Record, showing a non-immigrant classification that allows me to work lawfully in the US. Classifications include: E/H/I/J/L/O/P/Q/R visas (but they don't include F-1 visa here)
                        • A copy of an unexpired EAD
                        • A copy of an unexpired Form I-94, A/D Record, with "Employment Authorized."
                        Last year, I was studying for my Masters, and did two internships on my CPT, so my income came from there. This year, I work under non-STEM OPT. Among the suggested documents, I only have the unexpired EAD.

                        My lawyer said he will send my documents again, which is already sent in the first package. He will also include a letter explaining my income has been lawfully earned.

                        But I'm thinking about another option. I want to send an additional I-864 of my wife's mother and stepfather. Their income is way above the threshold line. I just don't know if the USCIS accept additional I-864s, which weren't sent in the first place. I'm afraid that if I send things that was not in the first package, they will reject the whole package.

                        I would like to hear your thought on my case. Should I stick with my first package, or should I include additional I-864s?

                        Really appreciate any thought on this issue.

                          I want to clarify a little bit. My first package of I-864 included my 3 years tax returns, tax transcripts. 2019 W-2s, copy of my EAD, I-20 with CPT approved and OPT requested.

                          My timeline:
                          • 7/7/20: Sent packages of I-130, I-485, I-765
                          • 7/13/20: PD of I-130 and I-485
                          • 8/5/20: received Biometrics appointment, which takes place on 8/19/20
                          • 8/8/20: received RFIE

                            I would recommend calling them again since you're beyond 30 days and requesting to raise a query. It depends on the call center agent as well and their willingness to help.

                                There is nothing to disallow adding a joint sponsor, but looks like that won’t be necessary given your joint income surpasses the threshold for your family size. If I were you, I’d submit what they asked for and let the processing continue. Keep us posted whatever you decide!
