In other news - I read that Public Charge rule has been blocked by a Federal judge during the pandemic. I tried posting a link but the admin removed it. Not sure what the DHS is going to do about it. And if it will apply to us since we filed before the ruling. And also the Republican proposed relief bill does contain the money for USCIS so hopefully they are not planning to let the furlough go through.

Also I read online on ********* yesterday that USCIS only accepts Tax Transcript for I944 and NOT 1040s. And I realize I have only submitted 1040s and W2s for the 2019 tax year as IRS takes a long time to process Tax Transcripts and the fact that I had only recently filed for the 2019 tax returns. Just curious as to what did you guys submit for 2019 tax year for I944?
    I just submitted W2 and 1040

It’s very easy to download your tax transcripts from the IRS website. Takes only a few minutes.

      My Timeline:

5/15: Filed I140/I485/I765/I131 concurrent (Employment Based) for myself and spouse
5/18: Received at USCIS Texas lockbox
6/1: Reject notices received for all, except I-140, due to missing I-944
6/4: Re-filed and received I485/I765/I131/I944 at USCIS lockbox
      6/25: Received NOA receipts
7/25: Received ASC biometric appointment notices for myself and my wife, scheduled for 8/03
      8/3: Biometrics completed
8/4: Case status updated to "Finger prints applied"

I don’t know why ********* says USCIS accepts only tax transcripts. I personally sent ONLY tax transcripts for I-944 and I got an RFIE for me to send in my 1040s and W2s. So I don’t know what is making them say that.

anyways, I’m not a lawyer and this should in no way be construed to be a legal advice.

I also submitted my 1040's I could not access my tax transcripts online because the irs website requires a credit card or loan to create an account and I don't have that. They also took too long to send through mail since the office was closed at the time of my filing. My lawyer recommended to try to get the transcripts and have them ready for the interview if they ask for them. Otherwise I believe they would take the 1040's and w2 with no problem.

(I'm not attorney or anything this was recommended to me and I believe my lawyer so I think we'll be ok.)

You got RFIE just to submit 1040 and W2s just to submit for I944 despite submitting Transcripts? That's interesting and stupid on USICSs part. I guess there is no rule to this stupidity.

              • Do RFE's or RFIE's come before the I-797C forms are issued?

Still that does not make sense. the form I-944 clearly asks for Tax Transcript ONLY. They specifically say that is what they need and nothing else. Filing Married Jointly should not be an issue. The form ask for all the member of the family and their income per the tax return if any.
