  • Question about Expidite I-485

    Hi everyone, please help me if you know the answer.

    I'm currently in the US under F1 International Student. My mom sponsored me, and we filed the whole application I-485, EAD and Travel Authorization together in late March.
    • Application submitted on: Late March
    • Receive receipts: April 20th, 2020
    • Fingerprint fee accepted: May 13 2020
    • I'm currently waiting for the invitation for biometric, my field office (San Jose, California) is opened tomorrow July 13th.
    For those who have request to expedite, what paperwork did you submit. How did you do it? Since I'm on International Student visa and graduating in May 2021, I really need the green card by then. I've used all of my OPT (Authorization to work for International Student), which means by May, I have 60 days to depart the country.

    Please guide me if you know any information or any tips on how to expedite I-485

    Once your I-485 accepted, if you did not have any unlawful presence, you are good to stay.
    05/08/20: I-485, I-765, I-131, I-944 sent to USCIS
    05/13 Rejected due to lack of I-864
    05/27 resubmitted with explanation
    06/03 Rejected again-same reason
    06/13 Resubmitted with I-864
    07/07 Lockbox emailed back and ask to resubmit
    07/09 Filings accepted with PD 05/08/20 (nice)
    08/06 Prior biometrics applied to I485
    08/28 Took biometrics for I-765 only
    09/28 I-765's Cards Ordered
    10/02 EAD/AP received
    04/12 Interview Sched
    05/11 Interview done approval on the spot but no USCIS update online

      Hi everyone,

      Just add on to my question, when i request to expedite I-485, does that mean the EAD and the Travel Authorization will also be expedite?

        Is your mom USC or GC holder?
        Are you married?
        Are you younger than 21?
        Where were you born?
        Which Family-Bases preference?
        Nov 2018 - Package sent - EB - Texas Service Center
        Day 1 - Package received at the lockbox
        Day 999 - Card delivered to me - Aug 2021

            You can remain in the US as long as your I-485 is pending and hopefully at some point GC will be granted.

              You have no basis to expedite I-485 since I-485 processing being slow doesn't affect your ability to stay in the US.

                I'm no expert but I think that if your mother became a citizen or you get married, the situation will change. As long as there are no changes there you can stay and just keep renewing your EAD/AP.

                You can expedite your EAD/AP with a job offer, but it looks like you still have some studies to do. I will say that is good to finish your studies.

                If you want to work or travel abroad with your EAD/AP before graduation is good to inform your school so they can properly close your F1 status. You don't want to have problems down the road if they make a mistake. Keep copies of all your I-20s, OPT EADs, etc. USCIS may ask for some things not used for initial filling.

                  Hi,
                  Even though I'm on F1, I'm graduating soon, meaning without the EAD and AP i won't be able to work/accept job and will face financial lost.

                    Then you can try to expedite your I-765, but not your I-485.
