    Hi,

    I'm new here so apologize if anyone has already asked the question. I've been waiting for more than 2 years for my turn to file Adjustment of Status. Got my I-140 (eb1 category) approved in Aug, 2018. Been stuck ever since because of the backlog (I'm from China).

    The most recent Visa Bulletin (Aug 2020) made significant progress, which is great. But when I contacted my attorney who I haven't spoken to since, he said I should be looking at Chart A (final action dates) in the visa bulletin, rather than Chart B, which is (dates to file). I was looking at Chart B the whole time because I thought that's what it meant - for people who have not been able to file their I-485 to finally submit to file.

    Am I wrong or is my attorney confused?

    You look at USCIS's chart. Sometimes USCIS takes Chart A, and sometimes they take Chart B, but whichever chart they take, is the chart that applies for I-485 filing for that month. For employment-based categories, it is the Final Action Date chart for July and August.

      In order for USCIS to approve your green card, the priority date must be current on Chart A because Chart B is only used for filing the I-485, but not for issuing the green card.
