  • **Urgent Help** Employment verification by USCIS for I-485

I am in process of filing my AOS (I-485) with USCIS. My wife is primary applicant. I am her dependent. I was on H1-B earlier and changed my status to L2 and also received L2-EAD about a year before.

When I changed my status from H1-B to L2. I got notified by USCIS almost a month late via letter that my Status change was approved and online status never got updated it still shows "Case Received" on Case status page.

During that months time I was kept working on my H1-B status and as soon as I received my L2 approval I stopped working. Now L2 797 approval notice shows Notice date of Sep 1, 2019 but I stopped working on Oct 2, 2019. while my L2-EAD was still pending with USCIS

Now I am concern that will that be considered as unlawful employment as employment history shows that additional month I was working.

If you guys are in an employment-based category, being out of status or illegal employment are okay as long as you have been out of status or working illegally for less than 180 days since your most recent admission.

This is my personal opinion and is not to be construed as legal advice.
