  • I-765 Last Name and First Name Switched What to do?

    Hey Guys,

    My problem is that I just realized that I switched my last name and my first name on my I-765. I am afraid to call USCIS to have it change because I am afraid they will deny the application or send me a RFE.

    I know that sound stupid but I guess it was due to the stress that come with filing 3 AOS with all of these required forms. What do you think I should do? call them anyway?

    USCIS already told me that they will apply our previous Biometrics; therefore, my family and I would not need to do a new. I am the principal applicant.

    05/13 Rejected due to lack of I-864
    05/27 resubmitted with explanation
    06/03 Rejected again-same reason
    06/13 Resubmitted with I-864
    07/07 Lockbox emailed back and ask to resubmit
    07/09 Filings accepted with PD 05/08/20 (nice)
    08/06 Prior biometrics applied to I485
    08/28 Took biometrics for I-765 only
    09/28 I-765's Cards Ordered
    10/02 EAD/AP received
    04/12 Interview Sched
    05/11 Interview done approval on the spot but no USCIS update online

    I'd call them and ask for their recommendation for best way to correct this. I expect they will let you keep your priority date and ask you to resubmit with corrected information. Pls let us know how it goes.
    USC filed AOS for parents on B2. I am not a lawyer.

          If I were to be in your shoes, I’d call them almost immediately. It’s better for them to know, take the bitter pill now should you be rejected than to wait and be asked to start all over.

          Let’s know how it goes on Monday.

            Well- I tried today and they were closed. They can only reject my I-765 but they cannot based on that to reject my I-485. I looked my email and find in 2015, I had a similar issue with a case. I called and they were able to fix it for me. I will call them first Monday Morning and see what they say.

            I hope I won't to refile because they already accept my previous Biometric.

                That's a simple fix actually. I accidentally put maiden name instead of my middle name on myamy I131 I and did a SR for typographic error which is specifically for errors of this kind and they fixed it in a few days. There weren't any issues.

                      Thanks- I will call them early tomorrow morning to see if they will do it or if they want me to fill SR typographic form instead.
