Do I need police and court records if I have no history with police?

  • Do I need police and court records if I have no history with police?

    I have never been arrested, detained, charged or anything of that sort. I have had no run-ins with police. Do I still need to submit some sort of clearance certificate that I have no records?

    Per the guidelines of USCIS, unless I’m mistaken, you should only submit police records if you’ve been arrested and/or had an encounter with the law of such nature. So unless applicable, I don’t think you should provide any police records - I’m not a lawyer, this is just my 5 cents.

      Thanks, that makes sense. To be honest, USCIS instructions are pretty clear. I just hope they would add one more line at the bottom, something like "If none of the above cases apply to you, you don't need to submit this".

          I-485, question #25, I was pulled over by the police and was given a citation for speeding. I included the ticket and proof that was paid and explanation of what happened. Question #25 is very clear, don't lie about anything. Good luck!

            In all likelihood, you will have problems related to not reporting these kind of infractions if they were criminal or something serious. Minor things like speeding tickets should not cause a problem. For what it’s worth, I have had a speeding ticket for which I did traffic school, but it was not mentioned on my citizenship application, and that did not cause a problem with my naturalization. Hope this helps.
