  • RFIE about I-864

    AOS filer married to USC. I received an RFIE regarding my I-864. I need to revise the form . This may be a dumb question. I’m second guessing my answer in “household size” since it was mentioned in the RFIE. My USC husband is petitioning for me. Both of us don’t have any kids or dependent. No other persons being petitioned. I put in “2” as the total household size. Is this wrong?? We just got married this year 2020 so his 2019 return shows him as single with no dependent. Idk if that matters.


    This is a portion of my RFIE letter. Are these 4 bullet points a standard language/list for I-864 or are these 4 specific items specific to me (what they think is incorrect in my paper)?


    “You have submitted i864.. we are unable to process the i864 bec it has one or more deficiencies. in order for us to process further, you must:
    • Submit a completed and signed form…
    • Provide sponsor’s SSN…
    • Provide a complete and correctly calculated household size for the petitioning sponsor on Form I-864
    • Submit a complete copy…. “

    8/26 - Sent expedite assistance to Congressman & Ombudsman
    8/27 - Sent expedite request to USCIS
    8/31 - USCIS declined expedite request
    10/16 - Submitted e-request - did not receive notice by mail
    12/11 - biometrics appointment

    What were the answers for Part 5 questions 1, 2 and 3.
    they should have been 1, 1 and blank (since no family member should be counted twice.)

    Also, your husband needs to sign this form, not you.

    Is that how it was done?
    USC filed AOS for parents on B2. I am not a lawyer.

      Did you answer 1 in Part 5, 1?
      Did you answer 1 again in Part 5, 3?

      I think you should answer Part 5, 1 and Part 5, 2 with 1 and total 2 (Part 5, 8), even if you are married to avoid duplicate count.

      Edit: I was too slow to answer. I was reviewing the form and had a call while writing my answer, that's why it is 30 min later

          Were you able to figure out what the issue was with your RFE?
          Currently on F1 OPT - Married to USC - Concurrent filing.

            Yep. This is how i did it with the household size. my husband signed the document. I figured put what happened. I used Preview (im a mac user) when i filled out my 864. Apparently, It auto computes if you use adobe acrobat reader but not other pdf app. It generated “2” households. Same as my manual answer so it would not have made a difference. Should i assume his is standard reminder?

            all 10 pages are there. I know I Need to work on 2 things: i overlooked my petitioner’s ssn. Total income computation needs updating (the letter has an additional comment on this).
            other than that, this portion of the letter seem like standard reminder.

              re the household size, It works better to fill out the for, using adobe acrobat reader. My manual computation and the auto-computation yielded thenaame amswer - 2 households.

              im pretty sure i submitted the complete pages with my husband/ petitioner’s signature. i checked my scanned backup copy) Ill look at other forums for added resources one last time and then Ill resubmit along with their other comments/requirements and see what happens.

                Yep. That’s the answer I put in. 2 person. I counted myself only once.
