  • I-485 for traffic violations involving property damage and personal injuries

    I was involved in a traffic accident several years ago. I wasn't under any influence and was not arrested but a passenger in another car got injured as a result. I know that I need to disclose and provide documentation for the accident per the instructions, but I am wondering what documentation I need to provide/if I need to provide anything regarding the injured passenger's injuries. The accident report is the only thing I have...

    Also, how serious is it that the accident involved damage to properties and injuries to other people? Would my application be denied as a result?

    You need to answer yes to question 25 in the i-485 form, you need to include any tickets that were given to you, you need to include the police report, and most importantly you need to include any documentation that shows that the person that was involved in the accident is fine and that any bills were taking care of, you need to write a small explanation on the additional information page, good luck!

      I see. Thank you!! I had an insurance policy that has a $1m coverage for the injured but for some reason I think that injured passenger didn't get her bills covered and this matter is now becoming a bit complicated. She sued me,Hertz, Nationwide mutual insurance company, and state farm mutual insurance co. because her bills were not covered. The lawyer appointed by Hertz for me said that the passenger claimed to have neck tissue issues. In this case how would you advise going about getting any documentation related to her injuries or should I disclose the complete information about the lawsuit as well?

        You probably need to talk to a lawyer. I don't think having accident matter if you did not get arrested. My brother was in an accident. The other person was killed. His insurance took care of that and was on probation for 6 months before allow to drive. He married last September and had his Permanent resident last February. I don't think having an traffic accident matters. In fact, having a moving ticket violation does not need to be reported.
        05/08/20: I-485, I-765, I-131, I-944 sent to USCIS
        05/13 Rejected due to lack of I-864
        05/27 resubmitted with explanation
        06/03 Rejected again-same reason
        06/13 Resubmitted with I-864
        07/07 Lockbox emailed back and ask to resubmit
        07/09 Filings accepted with PD 05/08/20 (nice)
        08/06 Prior biometrics applied to I485
        08/28 Took biometrics for I-765 only
        09/28 I-765's Cards Ordered
        10/02 EAD/AP received
        04/12 Interview Sched
        05/11 Interview done approval on the spot but no USCIS update online

          Hmm I see. Thanks for sharing your experience; that does help reassure me a bit. Did he have a lawyer assisting him with the case and do you know if he got asked a lot of questions about this at the interview?

            He has a lawyer to file for him but I don't think he did anything special aside from filing for him. He did told the officer did talk to him about the accident and they did ask him one question about it. The officer moves on and approve his PR that day.

              well, that is self-explanatory, it is obviously that you don't have the documentation, I would rather gather the information that says that your insurance companies are being sued by that person so you basically wash your hands off. I don't think this is something super serious but for God's sake they want you to have "good moral". Having that set, I think it's great that you disclose this beforehand.

                  I am in similar situation . I have an accident after my 1-485 was filed . The insurance has already paid for car damages and is looking into the other claims . I did not receive a citation or ticket . But there is an accident report which states minor accident. There was no injury as such but the person complained about the slight neck pain. Hence the report states "suspected minor injury". I would like to know how you went through about it and what happened in the interview . The claim is still not closed . Will these impact the visa renewal application or EAD or I-765 or I-485 process .
