  • RFE after I-485 interview

    Hi guys,

    Recently I just finished the marriage based I-485 interview. Me and my wife have married for 21 months, and our only kid is already 15 months old, so based on our situation, the officer who interviewed us didn’t ask us many questions about our marriage, but, printed us a RFE letter at the end of the interview to ask me provide evidence that proves I attended school in the past. I did attend the school and I have enough documents could prove that, but the problem is, the RFE letter exactly asks me to provide a school-sealed envelope including certified transcript, and tuition bills. It’s not a big deal in normal times, but currently the school office suspended its operation because of the COVID-19 and no specific re-open time is given, I tried to contact the school through the phone and email, but got no response. This school is a language school, because of the current situation, I think the school might be experiencing a tough time because no source of students, so it will probably continue shutting down in the next couple months.

    So, my questions is, should I submit the documents I have in my hand at this moment, like I-20, school-issued certification of attendance, transcripts, part of the tuition bills instead of the school-sealed documents that the officer requested, or, I have to spent much more time to contact the school and ask them to provide the documents? If based on the contents, I think what I have in my hand at this moment could completely prove what USCIS asks me to prove, but based on what USCIS asks me to provide, I am not able to provide the exact qualified documents.

    What should I do, guys.

    If the RFE asks for a school-sealed envelope, then that is what you should try to get. If after doing everything you could do to get what the RFE asks you can't get it, then you should send the documents and a long explanation with proof of all you did to get the sealed envelope before the RFE expires.

      Thanks for your reply, Enub4, actually the officer who interviewed us told us just show sth could prove that, and it would be fine, but the letter she printed out shows we need to submit school-sealed envelope, so we think probably she just used a template to print the letter. Even though things are like that, we still cannot just ignore the request on the letter, that’s the problem.

      One more question, the RFE letter states “You need to submit the evidence the proves that you attend the school. This includes, but not limited to”, I wonder the sentence “this includes, but not limited to” is another meaning of school-sealed envelope is just an example what I can submit?? IF so, I can just send what I have in my hand, but I’m not sure I can understand this sentence that way. Any thoughts, guys?

        If it says it includes but not limited to that means they are ready to accept other forms of evidence. But just as Enub4 said, I believe you should add an explanatory note to give more details on why you’re unable to provide a school-sealed evidence.
