  • Urgent help RFIE

Hi guys, I have a quick question and thanks in advance for your reply.
    Same sex couple here.
My partner is the petitioner. He was unemployed but till March 01 2020, when he got a side job at a hair salon. His boss gave him an offer letter in which says he can make up to $48K this year. However, because of business being so slow due to covid he's made about $6K only so far.
We sent the documents to USCIS on June 29th, and we got a RFIE on August 5th asking for his pay stubs, and letter of employment.
What is driving us crazy is that we typed $48K as the current anual income in the I-864, and we are now trying to see how to explain this to USCIS. This is our only shot.
We have a joint sponsor who's included in the original package. I already got the joint sponsor pay stubs and letter of employment. We got the joined sponsor because for the past year my partner didn't have an income, so I thought it was a good idea to actually have a join a sponsor just in case. Our join sponsor makes over 100k a year.
My partner's boss pays him cash, thru venmo. However he says his boss will give him actual pay stubs.
I am just scared that immigration will come back and say "hey, you started this job in March, and till today you've made $6K only, if you filed in June, why did you say $48K If the year is almost over?".....
    Maybe I'm over thinking?
You're help is very much appreciated.
    Thx!

I had this exact scenario where they asked for paystubs and employment letter. My lawyer handled sent out a letter and reminded them that we have joint sponsor and asked them to use the joint sponsor Information we included in the original application packet. We also included in the reply a letter signed by my daughter that stated at the time we filed, potential income was this much, but now circumstances changed being in college and now working less. They accepted that response and continued to adjudicate the cases. Best of luck!
